Sec. 4 -18 Annual Review of Fees <br />The Common Council shall review annually all license fees <br />charged by the City. All fees shall be reasonably related to the <br />cost incurred by the City in regulating specified businesses. <br />Article 5 Specific Business Regulations <br />Sec 4 -19 Arborist License <br />(a) License Required. No person shall engage in the business <br />of planting, removing, trimming or spraying trees or shrubs within the <br />City without first obtaining an annual arborist's license authorizing <br />such person to engage in such business. <br />(b) Application. Each applicant for the license shall procure <br />from the Office of the Controller an application for such license. No <br />license shall be issued by the Controller until the application has <br />been approved by the Board of Park Commissioners. The approval shall <br />not be granted unless the Board is satisfied of the competency of the <br />applicant to engage in such business. <br />(c) Insurance Prerequisite. Before an arborist's license is <br />issued the applicant shall be required to file with the Controller <br />a certificate of insurance as proof that the licensee is carrying <br />public liability insurance in an amount of not less than twenty -five <br />thousand dollars ($25,000.00) for each person, fifty thousand dollars <br />($50,000.00) for each accident, and property damage insurance in an <br />amount of not less than five thousand dollars ($5,000.00) for each <br />accident or such greater amount as may be established by the Board <br />of Park Commissioners. The proof of insurance shall be filed each <br />year before an annual license is granted. <br />(d) Issuance Fee. Upon recommendation of the Board of Park <br />Commissioners and proof of public liability insurance, the Controller <br />shall issue an arborist's license to an applicant upon payment of <br />the following fees: <br />(1) for engaging in the arborist business, Thirty dollars <br />($30,00) per year. <br />-(2)- for each vehicle used in conducting the arborist business, <br />Three dollars ($3:.00) per year, for which numbered license plates <br />shall be issued. <br />(e) License Revocation. <br />In the event of any violation of the provisions of the Chapter <br />the laws of the State pertaining to the planting, removal or <br />maintenance of trees or shrubs in the City, or any of the rules of the <br />Board of Park Commissioners which may be adopted in accordance with <br />the provisions of this Code, by any licensed arborist, in addition <br />to other penalties which may be provided for violation of this Code, <br />the City Controller may, upon evidence being presented by the Department <br />of Public Parks, revoke such license for the causes stated and in <br />accordance with the procedures established in section 4 -16 of this <br />Chapter. <br />Sect. 41 -:2,0 through Sec. 4 -24 RESERVED <br />(a) Definitions. As used in this section: <br />1) Food vending vehicle means any vehicle from which <br />food items such as ice cream, candy, or other food sundries <br />are sold directly to a consumer at retail, and which is operated <br />on any public road, street or other place within the City. <br />-7- <br />
