,Sec. 4 -36 RESERVED <br />Sec. 4 -37 RESERVED <br />Sec. 4 -38 Operi Air Stands <br />(a) Every person who erects, places or stands in the <br />City an open air booth, shed, tent, or stand for the purpose of <br />selling, bartering or exchanging on or from such place any goods, <br />wares or merchandise, which terms shall include also all fruits, . <br />vegetables, country produce, refreshments and confectionery, before <br />engaging in such business shall obtain a license from the Controller. <br />The license shall designate the place where such stand is to be <br />operated and the kind of booth, shed, tent, or stand in and from <br />which such articles are to be sold. <br />(b) If the location for a stationary open air business <br />is on private property, the applicant shall attach a signed statement <br />from the real property owner granting permission for the location, <br />and this shall be attached to the application. <br />(c) Applicants desiring to sell only goods, merchandise, <br />fruits, vegetables, or produce by weight or measure, shall present a <br />certificate signed by the Sealer of Weights and .Measures showing <br />that all scales and measures have been tested and approved, at the <br />time of making application. <br />(d) The license fee for a stationary open air business, <br />if conducted on private property shall be Five Dollars ($5.o(bler day, <br />or a- Twenty Five Dollars - per- men-th-"atld- ($25.00) minimum, or One Hundred <br />Fifty.Dollars.($'l_50.:00 er year. If the open air business is to be conducted <br />upon public places then such license fee shall be Five Dollars ($5,00.) <br />per day,or a Twenty - five($ 25.0O�er-mont'h-,--and minimum, or Two hundred <br />Dollars,($200.0 er year. The figures shall measure not less than eight <br />(8) inches in height.
