Property located at Northwest <br />corner of intersection of <br />Riverside Drive and Angela <br />Avenue in South Bend, Indiana <br />ORDINANCE NO. 7024 -82 <br />AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, <br />AS AMENDED, COMMONLY KNOWN AS THE ZONING OR- <br />DINANCE OF THE CITY OF SOUTH BEND, INDIANA <br />(CHAPTER 21, MUNICIPAL CODE). <br />BE IT ORDAINED by the Common Council of the City of <br />South Bend, Indiana: <br />Section 1. Ordinance No. 4990 -68, as amended, which <br />ordinance is commonly known as the Zoning Ordinance of the City of <br />South Bend, Indiana, be and the same hereby is amended in order that <br />the zoning classification of the following described real estate in <br />the City of South Bend, St. Joseph County, State of Indiana: <br />A part of the Northeast and Northwest Quarters of Section 2, Town- <br />ship 37 North, Range 2 East commencing at a point that is the <br />intersection of the South line of the right -of -way of the Michigan <br />Central Railway with the Northeasterly line of an alley produced, <br />which line is One Hundred Thirty -four (134) feet measured at right <br />angles from the Northeasterly line of Woodward Avenue which is also <br />the Northeasterly line of Portage Park, 2nd Addition to the City of <br />South Bend; thence Southeasterly along said line a distance of <br />143.3 feet more or less to a point that is the intersection of <br />said line with the Northerly right -of -way of Angela Avenue; thence <br />Northeasterly along a curve to the right (with a radius of 770.8 <br />feet and a chord of 187.44 feet, more or less) for a distance of <br />187.9 feet, more or less; thence continuing along the North right - <br />of -way of Angela for a distance of 381 feet, more or less, thence <br />North 000 to the South line of the right -of -way of the Michigan <br />Central Railway; thence Westerly along said South right -of -way to <br />the point of beginning, containing 1.8 acres, more or less. <br />be and the same is hereby established as a D -Light Industrial Use <br />District and an A- Height and Area District. <br />Section 2. This Ordinance shall be in full force and <br />effect from and after its passage by the Common Council, approval <br />by the Mayor, and it shall be subject to the following conditions: <br />1) That a written lease not to exceed twenty (20) <br />years (excluding renewal options) be executed <br />by and between the City of South Bend, Indiana, <br />as lessor, and a lessee. <br />2) That said lease shall become effective following <br />its approval by the Common Council. <br />3) That Resolution No. 17 which was adopted by the <br />Board of Public Works on August 24, 1981, and <br />ratified by the Common Council on August 31, 1981, <br />shall be null and void upon the happening of <br />condition 2 above. <br />/.X M'k <br />Member of the Common Council <br />Passed as amended February 8, 1982 <br />
