Property located at Northwest corner of intersection of Riverside Drive and Angela Avenue in South Bend, Indiana ORDINANCE NO. 7024 -82 AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING OR- DINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE). BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: Section 1. Ordinance No. 4990 -68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: A part of the Northeast and Northwest Quarters of Section 2, Town- ship 37 North, Range 2 East commencing at a point that is the intersection of the South line of the right -of -way of the Michigan Central Railway with the Northeasterly line of an alley produced, which line is One Hundred Thirty -four (134) feet measured at right angles from the Northeasterly line of Woodward Avenue which is also the Northeasterly line of Portage Park, 2nd Addition to the City of South Bend; thence Southeasterly along said line a distance of 143.3 feet more or less to a point that is the intersection of said line with the Northerly right -of -way of Angela Avenue; thence Northeasterly along a curve to the right (with a radius of 770.8 feet and a chord of 187.44 feet, more or less) for a distance of 187.9 feet, more or less; thence continuing along the North right - of -way of Angela for a distance of 381 feet, more or less, thence North 000 to the South line of the right -of -way of the Michigan Central Railway; thence Westerly along said South right -of -way to the point of beginning, containing 1.8 acres, more or less. be and the same is hereby established as a D -Light Industrial Use District and an A- Height and Area District. Section 2. This Ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor, and it shall be subject to the following conditions: 1) That a written lease not to exceed twenty (20) years (excluding renewal options) be executed by and between the City of South Bend, Indiana, as lessor, and a lessee. 2) That said lease shall become effective following its approval by the Common Council. 3) That Resolution No. 17 which was adopted by the Board of Public Works on August 24, 1981, and ratified by the Common Council on August 31, 1981, shall be null and void upon the happening of condition 2 above. /.X M'k Member of the Common Council Passed as amended February 8, 1982
