ORDINANCE NO. 70.7D-8a AN ORDINANCE REQUESTING VACATION OF VARIOUS PUBLIC RIGHTS -OF -WAY IN THE MONROE- SAMPLE DEVELOPMENT AREA IN THE CITY OF SOUTH BEND, INDIANA STATEMENT OF PURPOSE AND INTENT The Common Council recognizes the need for the orderly redevelopment of the Monroe- Sample Development Area. The Council recognizes that certain alterations of the existing street and alley pattern are needed to facilitate the orderly redevelopment of the area. In order to promote the redevelopment of the Monroe - Sample Industrial Park, the following described public rights -of -way are to be vacated. SECTION I: The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: Public rights -of -way being a part of the City of South Bend, Portage Township, St. Joseph County, Indiana, and being more particularly described as follows, viz: All East -West and North -South alleys bounded by Bronson Street, Marietta Street, Sample Street and Fellows Street in John Rush's 4th Addition, E. H. Rush's 1st Addition, E. H. Rush's 2nd Addi- tion, Gallagher's 1st Addition. Clinton Street between Bronson Street and Sample Street in John Rush's 4th Addition, E. H. Rush's 1st Addition, Gallagher's 1st Addition. Rush Street from Bronson Street to a point 239.10 feet south in John Rush's 4th Addition. The East -West and North -South alleys bounded by Columbia Street, Bronson Street, Fellows Street, and the Conrail viaduct in A. R. Sample's Sub of Lots 26, 27, 28 of Denniston and Fellows Addition. be and the same is hereby vacated. SECTION II: The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches within the vacated rights -of -way, unless such rights are released by the individual utilities. SECTION III: This ordinance shall be in full force and effect from and after passage by the Common Council, approved by the Mayor, and legal publication. 1st READING / `// —eo?
