<br />9 <br /> <br />of a written request from the Company, the City shall certify to the Company and to any lender of <br />the Company or purchaser of the Project the status of inspections of the Project, including any final <br />inspection, and whether any material defects in the Project identified in any non-compliance notice <br />have been remedied. <br />4.07 Insurance. During construction of the Project, the Company shall maintain or <br />caused to be maintained the policies of insurance described on Exhibit F. Each such policy shall: <br />(a) be written by a company reasonably acceptable to City; and (b) provide that it shall not be <br />modified or canceled without written notice to City at least thirty (30) days in advance. The policy <br />of general liability insurance shall name the City Bodies as additional insureds. The Company shall <br />deliver to City certificates of the insurance policies required by this Section 4.06, executed by the <br />insurance company or the general agency writing such policies. <br />4.08 Employment of Local Labor. The Company hereby agrees to provide notice to <br />local contractors of all requests for bids, pre-bid meetings, and related meetings and information <br />with respect to the Project so as to use commercially reasonable efforts to employ qualified local <br />contractors and other related local labor during construction of the Project. The Company agrees <br />to meet with the business agents of all skilled trade unions to give them the details of the Project <br />prior to contracting for the completion of the Project. For purposes of this section, the Company <br />shall be deemed to have acted in a commercially reasonable manner if it considers bids by local <br />contractors and other related local labor in good faith in light of their experience, reputation and <br />other qualifications. The Company shall not be required to award work to a local contractor or <br />other related local labor simply because the contractor or other related labor submits the lowest bid. <br />4.09 Reporting Obligations. <br />(a) Local Reporting. Upon the letting of contracts for substantial portions of <br />the Project and again upon substantial completion of the Project, the Company hereby <br />agrees to report to the Redevelopment Commission the number of local contractors and <br />local laborers involved in the Project, the amount of bids awarded for each contract related <br />to the Project, and information regarding which contractor is awarded each contract with <br />respect to the Project. <br />(b) Semi-Annual Reporting. On or before June 30 and December 31 of each <br />year until substantial completion of the Project, the Company shall submit to the <br />Redevelopment Commission a report, in the format set forth at Exhibit G, demonstrating <br />the Company’s good-faith compliance with the terms of this Agreement. The report shall <br />include the following information and documents; (i) a status report of the construction <br />completed to date, (ii) an update on the project schedule, (iii) an itemized accounting <br />generally identifying the investment in the Project by the Company not including proceeds <br />of the Bonds, and (iv) a status report of the number of jobs created for employment at the <br />Project Site. <br />4.10 Equal Employment Opportunity. The Developer, for itself and its successors and <br />assigns, agrees that during the construction of the Project:
