ORDINANCE NO. '7,Q <br />AN ORDINANCE REQUESTING VACATION <br />OF A PUBLIC RIGHT -OF -WAY IN THE <br />MONROE- SAMPLE DEVELOPMENT AREA <br />STATEMENT OF PURPOSE AND INTENT <br />The Common Council recognizes the need for orderly redevelopment of the <br />Monroe - Sample Development Area. <br />The Council recognizes that certain alterations of the existing street <br />and alley pattern are needed to facilitate the orderly redevelopment of <br />the area. <br />In order to promote the redevelopment of the Monroe- Sample Industrial <br />Park, the following described public right -of -way is to be vacated. <br />SECTION I. <br />Public right of way being a part of the City of South Bend, Portage Town- <br />ship, St. Joseph County, Indiana, and being more particularly described <br />as follows, viz: <br />The North -South alley bounded by Bronson Street; Rush Street; Clinton <br />Street; and the first East -West alley south of Bronson Street in John <br />Rush's 4th Addition, <br />be and the same is hereby vacated. <br />SFCTTnN TT_ <br />The City of South Bend hereby reserves the rights and easements of all uti- <br />lities and the Municipal City of South Bend, Indiana to construct and main- <br />tain any facilities, including, but not limited to, the following: electric, <br />telephone, gas, water, sewer, surface water control structures and ditches, <br />within the vacated right of way, unless such rights are released by the <br />individual utilities. <br />SECTION III. <br />This ordinance shall be in full force and effect from and after passage by <br />the Common Council,, approval 'by the Mayor and legal publication. <br />z -d READING <br />tdCT APPROVER <br />REFERRED <br />PASSED <br />FILED IN CLERK'S OFFICE <br />Jt1N � 1-0 ,102 <br />Irene Gammon <br />CITY CLERK, 3011TH BEND, IND. <br />
