South Bend Redevelopment Commission <br />Regular Meeting —April 25, 2013 <br />Sub. The rezoning request includes a change in use from "LI" Light Industrial to "O" <br />Office. <br />Per Article 3.5 of the Blackthorn Corporate Park Declaration of Protective Covenants and <br />Restrictions, owners of more than 5% of the corporate park must seek authorization from the <br />Redevelopment Commission before proceeding with the property rezoning process. As a <br />courtesy, the Board of Directors of the Blackthorn Owners Association has been notified of <br />this action. <br />The Commission's listing agent, Cressy and Everett/Grubb & Ellis, has requested the <br />rezoning. They have an option agreement with the Commission for the property. The new <br />zoning would allow for: <br />1. Consistency with the assigned use designation of Support Office/Research for the lots <br />in question within the Corporate Park Covenants & Restrictions. <br />2. Greater development opportunities in "O" Office. <br />Staff requests Commission authorization for Cressy and Everett to begin rezoning process. <br />Mr. Rick Doolittle, Cressy and Everett, noted that a year ago Cressy entered into a contract <br />with Divita for a medical renal care facility in Blackthorn. That was the first fresh activity <br />they've had in Blackthorn since they became the Commission's listing agent. It has <br />stimulated a lot of interesting activity throughout the park, including another medical <br />facility. Cressy and Everett has also had interest expressed from a regional financial group <br />that is considering relocation of their headquarters. They have identified one of these three <br />sites as being their first choice. While talking with these interested parties, Mr. Doolittle <br />represented that those properties were zoned "O," because he thought all the lots in <br />Blackthorn were zoned for office. He apologized for the oversight, but asked the <br />Commission to authorize the rezoning so that they might secure these developments. <br />Ms. Jones asked whether there are other areas in Blackthorn that are zoned as "LI ", or will <br />this rule out light industrial as an option in the corporate park. Mr. Doolittle responded that <br />if the office developments don't work out and there is an opportunity for a light industrial, <br />then he'll be back to the Commission to have it changed. However, the decisions that are <br />being considered now will require office zoning. Once the decisions are made, these <br />companies will need to move quickly. <br />Upon a motion by Mr. Downes, seconded by Mr. Varner and unanimously carried, the <br />Commission authorized Grubb & Ellis /Cressy & Everett to proceed with a petition for <br />rezoning Lots 4P, 4Q and 4R (otherwise known as Lots 6, 7 & 8) in Blackthorn Corporation <br />Park. <br />C.
