<br />This being the time heretofore set for public hearing on the above bill, proponents
<br />and opponents were given an opportunity to be heard. Council Member Slavinskas made
<br />a motion to amend the bill in Section 5 by changing the period to a comma and adding
<br />"and shall be further contingent on the State Tax Commissioner's final approval on
<br />the new Riley High School project. ", seconded by Council Member Puzzello. The motion
<br />carried. Council Member Slavinskas reported that the Zoning and Vacation Committee
<br />had met on this bill and sends it to the Council with no recommendation. Ralph
<br />Komasinski, 1319 E. Wayne North, made the presentation for the bill. He indicated
<br />that the School Board voted to build a new facility at the present Riley site in
<br />1992. He indicated they were asking to have the street and alley vacation in order
<br />to allow for a campus that will provide for safe access for students. He indicated
<br />this bill allow them to have off - street bus facilities, parking, and not be in the
<br />floodplain of Bowman Creek. He indicated the South Bend School Corporation is not
<br />being asked to participate in the widening of Ewing. Vicky Black, 1218 E. Dayton;

<br />Schafer, 19218 Orchard Heights Dr., Pat Shelton, 1624 S. Scott; Jeff Reed, 737
<br />Altgeld; Hollis Hughes, 6126 Miami; Joe Kernan, 114 E. Pokagon; Charles Roberts 518
<br />E. Milton; spoke in favor of this vacation. Jo Blacketor, 906 E. Eckman; Joyce
<br />Boaler, 1606 Hillsdale; Gene Oakly, 26514 York Rd.; Lewis Clark, 401 E. Indiana;
<br />Judith Overmeyer, 3447 S. Locust Rd.; Ernest Dickson, 2706 Wall; spoke against this
<br />vacation. Council Member Kelly made a motion to recommend this bill to the Council
<br />favorable, as amended, seconded by Council Member Washington. Council Members
<br />Coleman indicated he was against this zoning. Council Luecke indicated he felt this
<br />petition was premature. Council Members Puzzello; Ladewski, Duda; and Kelly spoke in
<br />favor of the vacation. The motion carried.
<br />Council Member Coleman made a motion to recess, seconded by Council Member Duda. The
<br />motion carried and the meeting was recessed at 8:47 p.m., and reconvened at 8:56 p.m.
<br />BILL NO. 72 -93 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA,
<br />AMENDING ARTICLE 14 OF CHAPTER 2 OF THE SOUTH BEND MUNICIPAL CODE BY
<br />ADDING A NEW SECTION 2 -169.2 ENTITLED "CONSOLIDATED BUILDING
<br />DEPARTMENT ENTERPRISE FUND ".
<br />This being the time heretofore set for public hearing on the above bill, proponents
<br />and opponents were given an opportunity to be heard. Council Member Puzzello
<br />reported that the Personnel and Finance Committee had met on this bill and
<br />recommended it to the Council favorable. Kevin Horton, City Controller, made the
<br />presentation for the bill. He indicated it was the intent of the City and the County
<br />that this department's operational costs be financed primarily through user fees,
<br />therefore, an enterprise fund should be established. Council Member Kelly made a
<br />motion to recommend this bill to the Council favorable, seconded by Council Member
<br />Slavinskas. The motion carried.
<br />Council Member Luecke made a motion to combine public hearing on the next three
<br />bills, seconded by Council Member Slavinskas. The motion carried.
