or a second (2nd) testing sample that is also a negative <br />Dilute Specimen [provided, however, that a second (2nd) <br />negative Dilute Specimen shall not constitute a <br />Non -Compliant Event if. (1) the MRO determines <br />that there is a valid medical reason for the second (2nd) <br />Dilute Specimen, or (2) such treatment is prohibited by <br />applicable law], (d) an Adulterated Specimen, (e) a <br />Substituted Specimen, (f) an Out -of -Temperature <br />Specimen, (g) any acts by an Employee that compromise <br />the testing protocol (i.e., washes his/her hands, flushes <br />the toilet, etc.) prior to being given direction from the <br />collection professional, (h) a Refusal To Submit (to an <br />alcohol or controlled substances test), (i) a failure to <br />submit to Post-Accident/Incident Testing (which shall <br />include a failure to test resulting from the Employee <br />leaving the jobsite prior to such Post-Accident/Incident <br />Testing), and 0) any other act or omission by an <br />Employee that BCRC determines, in BCRC's sole <br />discretion, to constitute a substantial or willful <br />non-compliance with the policies and/or procedures set <br />forth in this Policy. A Non -Compliant Event is also <br />commonly referred to as a "strike." <br />• Non -Negative means a urine specimen that is reported <br />as an Adulterated Specimen, a Substituted Specimen, a <br />Positive Test [for drug(s) or drug metabolite(s)], a <br />Non -Compliant Event and/or invalid. <br />• Observed Follow-[]Uv T estinshall be required, based <br />on an EAP evaluation for a Non -Negative or Positive <br />Test result, missed random, incomplete test/walk outs <br />and as provided in this BCRC Policy. All Follow -Up <br />Testing will be administered by the TPA (BCRC) and <br />must be observed. <br />• Observed Return To Duty Test or Observed RTD Test <br />is an observed test required by this BCRC Policy that <br />13 <br />
