REGULAR MEETING November 25, 2024 <br /> Councilmember Tomas Morgan also asked for clarification on whether the porch would be rebuilt <br /> close to its original design. <br /> Skip Morrell affirmed this. <br /> Guadalupe Barcenas explained that the porch was initially planned but the permit was denied <br /> because it didn't meet the current code. <br /> Skip Morrell noted that the original porch was too damaged due to the fire, and after setback issues <br /> were addressed, a contextual setback allowed the porch to be rebuilt as originally designed. <br /> Councilmember Lee held the public hearing, and nobody spoke. <br /> Councilmember Sherry Bolden-Simpson asked if the new conditions required a vote. <br /> Bob Palmer confirmed they would be attached to the ordinance and filed with the recorder's office. <br /> Councilmember Sherry Bolden-Simpson motioned to amend Bill No. 53-24 to include the new <br /> requirements,rotating the second door to the side,restoring the windows, and rebuilding the porch <br /> to its original design and send to the Full Council with a favorable recommendation, which was <br /> seconded by Councilmember Rachel Tomas Morgan and carried by a vote of nine(9) ayes. <br /> Council President Sharon McBride—Aye Council Vice President Sheila Niezgodski—Aye <br /> Councilmember Canneth Lee—Aye Councilmember Ophelia Gooden-Rodgers—Aye <br /> Councilmember Troy Warner—Aye Councilmember Sherry Bolden-Simpson—Aye <br /> Councilmember Dr. Oliver Davis—Aye Councilmember Karen L. White—Aye <br /> Councilmember Rachel Tomas Morgan—Aye <br /> 64-24 PUBLIC HEARING ON AN ORDINANCE OF <br /> THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA,TO VACATE THE <br /> FOLLOWING DESCRIBED PROPERTY: THE <br /> FIRST EAST-WEST ALLEY SOUTH OF HURON <br /> STREET BETWEEN SOUTH WALNUT STREET <br /> AND TERMINATING AT THE PARCEL <br /> IDENTIFIED AS 018-3082-319602 <br /> Bill No. 64-24 had been tabled until December 9, 2024. <br /> 65-24 PUBLIC HEARING ON AN ORDINANCE OF <br /> THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA,ADOPTING A MERIT <br /> BOARD SYSTEM GOVERNING THE SOUTH <br /> BEND POLICE DEPARTMENT(SUBSTITUTE) <br /> Clerk Tirado read the bill to the Council for its second (2°d) reading. <br /> After the second (2°d) reading, Councilmember Lee requested the committee report. <br /> Councilmember Tomas Morgan stated that Substitute Bill No. 65-24 went before the Health and <br /> Public Safety Committee and comes with no recommendation. <br /> Councilmember Lee requested that the petitioner(s) state their naive and address and share key <br /> points before the Council. <br /> Kylie Connell, Assistant City Attorney with offices at 701 W. Sample Street, South Bend, IN <br /> 46601, stated that the South Bend Police Department (SBPD) has two (2) options for its system: <br /> follow the state model or create a South Bend-specific model. The current system will not be kept <br /> due to input from the Fraternal Order of Police (FOP). The proposed South Bend model includes <br /> a one-year(1)probationary period starting after Field Training Officer(FTO) completion, instead <br /> of the swearing-in date as required by the state.This allows more time for training and assessment. <br /> Disciplinary procedures will remain similar to the Board of Public Safety's current process. Under <br /> the new system, discipline over five (5) days will be handled by the Merit Board, while the Chief <br /> will manage actions under five(5)days.The key difference between the state model and the South <br /> 4 <br />
