RESOLVE INTO THE COMMITTEE OF THE WHOLE Councilmember Dr. Oliver Davis motioned to resolve into the Committee of the Whole, which was seconded by Council Vice President Shiela Niezgodski and carried via a vote by voice. PUBLIC HEARINGS BILL NO. 42-24 PUBLIC HEARING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA,AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED 829 SOUTH 27TH STREET COUNCILMANIC DISTRICT NO. 3 IN THE CITY OF SOUTH BEND, INDIANA Clerk Tirado read the bill to the Council for its second (2nd)reading. After the second (2°d) reading, Councilmember Lee requested the committee report. Councilmember Dr. Davis stated that Bill No. 42-24 went before the Zoning and Annexation Committee and comes with no recommendation. Councilmember Lee requested that the petitioner(s) state their name and address and share key points before the council. Skip Morrell, Principal Development Planner, with offices on the 14th floor of the County-City building, discussed a rezoning request for 829 South 27th Street, owned by Two (2)Brothers Real Estate Investments LLP. The request seeks to rezone the property from Urban Neighborhood One (U 1) to Urban Neighborhood Two (U2) to legalize its current use as a triplex. Originally built in 1922 as a single-family home, the conversion date to three (3) units is unclear. The property, located near the mixed-use Mishawaka Avenue corridor, aligns with South Bend's Comprehensive Plan to provide diverse housing options. After addressing frontage design concerns with the petitioner, the Plan Commission recommended approval. Stephen Fryer, petitioner, 1251 North Eddy Street, Suite 200, South Bend, IN, 46617, confirmed that the project aligns with the comprehensive plan. Councilmember Rachel Tomas Morgan asked if the rendering shown in the presentation reflects the intended renovations. Stephen Fryer affirmed that the rendering reflects the intended renovations. Skip Morrell added that this agreement is a written condition. Councilmember Lee held the public hearing, and nobody spoke. Councilmember Dr. Davis motioned to send Bill No. 42-24 to the Full Council with a favorable recommendation,which was seconded by Council Vice President Niezgodski and carried by a vote of nine(9) ayes.
