REGULAR MEETING JANUARY 24, 1994 <br />This bill had third reading. Council Member Luecke made a motion to pass this bill, <br />seconded by Council Member Duda. The bill passed by a roll call vote of eight ayes. <br />ORDINANCE NO. 8457 -94 AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY <br />LOCATED AT 1512 W. FISHER STREET, IN THE CITY OF SOUTH BEND, <br />INDIANA. <br />This bill had third reading. Council Member Washington made a motion to pass this <br />bill, seconded by Council Member Kelly. The bill passed by a roll call vote of eight <br />ayes. <br />ORDINANCE NO. 8458 -94 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 21, ZONING, <br />OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, AS <br />AMENDED, RELATIVE TO FLOODPLAIN REGULATIONS, BY ADDING A NEW <br />SUB - SECTION TO ARTICLE 12, SECTION 21 -180, REGULATORY FLOOD <br />ELEVATION. <br />This bill had third reading. Council Member Washington made a motion to pass this <br />bill, seconded by Council Member Duda. The bill passed by a roll call vote of eight <br />ayes. <br />ORDINANCE NO. 8459 -94 AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: <br />THE FIRST NORTH -SOUTH ALLEY EAST OF N. COTTAGE GROVE AVENUE <br />FROM THE SOUTH LINE OF LOT 1 (KLINGEL'S SUBDIVISION OF <br />HEINTZMAN'S ADDITION) TO THE SOUTH RIGHT -OF -WAY LINE OF W. <br />GRANDVIEW AVENUE FOR A DISTANCE OF APPROXIMATELY 132.8 FT. <br />AND A WIDTH OF APPROXIMATELY 13.86 FT. ALLEY LOCATED IN <br />HEINTZMAN'S ADDITION AND KLINGEL'S SUBDIVISION OF <br />HEINTZMAN'S ADDITION TO THE CITY OF SOUTH BEND. ALSO, WEST <br />GRANDVIEW AVENUE FROM THE EAST RIGHT -OF -WAY LINE OF N. <br />COTTAGE GROVE AVE. Council Member Kelly made a motion to pass this bill, <br />seconded by Council Member Washington. The bill passed by a roll call vote of eight <br />ayes. <br />ORDINANCE NO. 8460 -94 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE <br />FIRST EAST -WEST ALLEY NORTH OF LINCOLNWAY WEST FROM THE WEST <br />RIGHT -OF -WAY LINE OF N. OLIVE ST. TO THE EAST RIGHT -OF -WAY <br />LINE OF THE FIRST NORTH -SOUTH ALLEY WEST OF NORTH OLIVE ST. <br />FOR A DISTANCE OF APPROXIMATELY 120 FEET; THE FIRST NORTH - <br />SOUTH ALLEY WEST OF N. OLIVE ST. FROM THE SOUTH LINE OF THE <br />FIRST EAST -WEST ALLEY NORTH OF LINCOLNWAY WEST, NORTH TO THE <br />SOUTH LINE OF THE FIRST INTERSECTING EAST -WEST ALLEY; AND A <br />PORTION OF FORMER LOTS 38 AND 39 IN OLIVE HEIGHTS ADDITION; <br />ALL MORE PARTICULARLY DESCRIBED IN SECTION I OF THIS <br />ORDINANCE. <br />This bill had third reading. Council Member Luecke made a motion to amend this bill, <br />as amended in the Committee of the Whole, seconded by Council Member Coleman. The <br />motion carried. Council Member Duda made a motion to pass this bill, seconded by <br />Council Member Coleman. The bill passed by a roll call vote of eight ayes. <br />RESOLUTION NO. 2090 -94 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH <br />BEND COMMONLY KNOWN AS 317 W. WASHINGTON STREET, AN ECONOMIC <br />REVITALIZATION AREA FOR PURPOSES OF A TEN YEAR REAL PROPERTY <br />TAX ABATEMENT FOR CENTRAL HIGH ASSOCIATES LIMITED <br />PARTNERSHIP. <br />WHEREAS, a petition for real property tax abatement has been filed with the City <br />Clerk for consideration by the Common Council of the City of South Bend, Indiana <br />requesting that the area commonly known as 317 W. Washington, South Bend, Indiana, <br />and which is more particularly described as follows: <br />Beginning at the intersection of the East line of William Street and the North line <br />of Washington Ave., in the City of South Bend, St. Joseph County, Indiana, thence <br />89'- 48' -08" east along the North line of Washington, 430.07 feet (426.50 ft., <br />records) to a Point on the West line of St. James Court (a 14.00 ft. wide Public <br />Alley); thence North 000- 01' -34" East along said line, 411.05 feet (410.00 Ft. <br />record); North 89 °- 43' -16" West along the South line of Colfax Avenue (82.50 ft. <br />side), 430.26 feet (426.36 ft., record); thence South 000- 00100" West (assumed <br />bearing) along the East line of William Street (66.00 ft. side), 411.66 feet (410.00 <br />ft., record) to the Point of beginning. Containing 176,950.524 square feet or 4.06 <br />acres. <br />and which has Key Number 18 1023 -0977 be designated as an Economic Revitalization <br />Area under the provisions of Indiana Code 6 -1.1- 12.1 -1 et. seq. and South Bend <br />Municipal Code Sections 2 -76 Et Seq. <br />
