<br />Elwood Avenue and Portage Avenue; thence East along the South line of Elwood
<br />Avenue 70.4 feet to the place of beginning.
<br />with said real estate having the following Key No. 18 1094 3941 an Economic
<br />Revitalization Area; and
<br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing
<br />before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and
<br />WHEREAS, the Council held a public hearing for the purposes of hearing all
<br />remonstrances and objections from interested persons; and
<br />WHEREAS, the Council has determined that the qualifications for an economic
<br />revitalization area have been met.
<br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend,
<br />Indiana, as follows:
<br />SECTION I. The Common Council hereby confirms its Declaratory Resolution designating
<br />the area described herein as an Economic Revitalization Area for the purposes of tax
<br />abatement. Such designation is for Real property tax abatement only and is limited
<br />to two (2) calendar years from the date of adoption of the Declaratory Resolution by
<br />the Common Council.
<br />SECTION II. The Common Council hereby determines that the property owner is
<br />qualified for and is granted Real property tax deduction for a period of ten (10)
<br />years, and further determines that the petition complies with Chapter 2, Article 6,
<br />of the Municipal Code of the City of South Bend and Indiana Code 6 -1.1 -12.1 et seq.
<br />SECTION III. This Resolution shall be in full force and effect from and after its
<br />adoption by the Common Council and approval by the Mayor.

<br />A public hearing was held on the resolution at this time. Ernest Szarwark, attorney,
<br />made the presentation for the bill. He indicated the store will be expanded adding
<br />12,000 square feet of space which will allow for an increase in the deli, meat and
<br />produce areas. He indicated ten new jobs will be created. Council Member Kelly made
<br />a motion to adopt this resolution, seconded by Council Member Zakrzewski. The
<br />resolution was adopted by a roll call vote of nine ayes.
<br />RESOLUTION NO. 2089 -94 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH
<br />BEND, INDIANA, APPROVING AN ORDER OF THE AREA PLAN
<br />COMMISSION OF ST. JOSEPH COUNTY, INDIANA, APPROVING A
<br />CERTAIN DECLARATORY RESOLUTION AND REDEVELOPMENT AREA
<br />DEVELOPMENT PLAN ADOPTED BY THE SOUTH BEND REDEVELOPMENT
<br />COMMISSION.
<br />WHEREAS, the City of South Bend, Indiana, Redevelopment Commission (Commission)
<br />has approved and adopted Resolution No. 1207 designating the Sample -Ewing Development
<br />Area, declaring the Sample -Ewing Development Area to be blighted, approving a
<br />development plan and conditions under which relocation benefits will be made, and
<br />establishing an Allocation Area for purposes of tax incremental financing; and
<br />WHEREAS, the Commission has submitted said Resolution No. 1207 to the Area Plan
<br />Commission of St. Joseph County for approval pursuant to the provisions of Indiana
<br />Code 36- 7 -14 -1, et seq., (the Act) which Resolution is attached hereto and made a
<br />part hereof; and
<br />WHEREAS, the Area Plan Commission of St. Joseph County, at its meeting of
<br />December 21, 1993, adopted Resolution No. 118, determining that Resolution No. 1207
<br />and the development plant attached thereto, conform to the Master Plan of Development
<br />for the City of South Bend, said Resolution No. 118 constituting the written order of
<br />the Area Plan Commission of St. Joseph County under I.C. 36- 7- 14 -16, a copy of which
<br />said Resolution No. 118 is attached hereto.
<br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend,
<br />Indiana, as follows:
<br />1. That Resolution No. 1207, adopted by the South Bend Redevelopment Commission
<br />on December 20, 1993, and the development plan attached thereto and incorporated
<br />therein, conform to the Master Plan of Development for the City of South Bend.
<br />2. That.Resolution No. 1207 of the South Bend Redevelopment Commission, and the
<br />development plan attached thereto and incorporated therein, are in all respects
<br />approved, ratified, and confirmed.
<br />3. This Resolution No. 118 of the Area Plan Commission of St. Joseph County
<br />shall be and hereby is approved pursuant to I.C. 36- 7 -14 -16 (b).
<br />4. That the City Clerk is hereby directed to file a copy of said Resolution No.
<br />1207 and said Resolution No. 118 with the minutes of this meeting.
