REGULAR MEETING <br />Irene Gammon, City Clerk Joseph Kernan, Mayor <br />JANUARY 10, 1994 <br />A public hearing was held on the resolution at this time. Council President Puzzello <br />read the resolution. She made a motion to adopt the resolution, seconded by Council <br />Kelly. The resolution was adopted by a roll call vote of nine ayes. Council <br />President Puzzello presented Council Member Luecke with an outgoing president's <br />gavel. Several Council Members expressed their appreciation of Council Member <br />Luecke's service to the City and the Council. Council Member Luecke expressed his <br />thanks. <br />RESOLUTION NO. 94 -2 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND <br />ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING POLICY FOR THE <br />PROVISION OF SERVICES TO ANNEXED AREA (RESERVOIR ANNEXATION). <br />Council Member Coleman made a motion to continue this resolution until the January 24 <br />meeting of the Council, seconded by Council Member Washington. The motion carried. <br />REPORTS OF CITY OFFICES <br />Police Chief Ronald Marciniak and Captain Darrell Gunn gave a report on drug <br />enforcement. Council Members question them regarding the Crack Busters and DARE <br />programs, as well as weapons disposal. They explained that weapons are made <br />inoperable and then melted down. <br />Council Member Coleman made a motion to resolve into the Committee of the Whole, <br />seconded by Council Member Zakrzewski. The motion carried. <br />COMMITTEE OF THE WHOLE <br />Be it remembered that the Common Council of the City of South Bend met in the <br />Committee of the Whole on at 7;47 p.m., with nine members present. Chairman Kelly <br />presiding. <br />BILL NO. 118 -93 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST <br />EAST -WEST ALLEY NORTH OF E. WASHINGTON AVE. FROM THE EAST RIGHT - <br />OF -WAY LINE OF N. FRANCES ST. TO THE WEST RIGHT -OF -WAY LINE OF <br />THE FIRST NORTH -SOUTH ALLEY EAST OF N. FRANCES ST. FOR A DISTANCE <br />OF APPROXIMATELY 113 FEET AND A WIDTH OF APPROXIMATELY 14 FEET. <br />ALLEY LOCATED AT COTTREL'S ADDITION TO THE CITY OF SOUTH BEND, <br />INDIANA. <br />Council Member Coleman made a motion to strike this bill at the request of the <br />petitioner, seconded by Council Member Zakrzewski. The motion carried. <br />BILL NO. 119 -93 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />ANNEXING TO THE CITY OF SOUTH BEND CERTAIN TERRITORY CONTIGUOUS <br />THEREWITH AND GENERALLY LOCATED WEST OF IRONWOOD ROAD AND SOUTH <br />OF IRELAND ROAD IN CENTRE TOWNSHIP, ST. JOSEPH COUNTY, INDIANA <br />(RESERVOIR ANNEXATION). <br />Council Member Slavinskas made a motion to continue this bill until January 24, <br />seconded by Council Member Zakrzewski. The motion carried. <br />BILL NO. 120 -93 <br />PUBLIC HEARING ON A BILL OF THE COMMON COUNCIL OF THE CITY OF <br />SOUTH BEND, INDIANA, AMENDING ORDINANCE NO. 8436 -93, WHICH <br />AMENDED CHAPTER 16 OF THE MUNICIPAL CODE ENTITLED "REFUSE ". <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Zakrzewski <br />reported that the Utilities Committee had met on this bill and recommends this to the <br />Council favorable. Jack Dillon, Director of Environmental Services made the <br />presentation. He indicated this bill that some private haulers collected refuse from <br />disadvantaged clients for only a few dollars per month, and asked Council to allow <br />for specialized collection services directly from their clients. He indicated this <br />bill allowed for this type of collection, as well as allowing the City to provide <br />such services; deletes the fee for specialized collection; and makes it lawful for a <br />person or company under permit with the City for specialized collection to collect <br />and dispose of residential refuse. Council Member Luecke made a motion to recommend <br />this bill to the Council favorable, seconded by Council Member Ladewski. The motion <br />carried. <br />BILL NO. 121 -93 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING CHAPTER 20, ARTICLE 1, SECTION 20 -17 OF THE MUNICIPAL <br />CODE AUTHORIZING INSPECTORS WITH THE DEPARTMENT OF CODE <br />ENFORCEMENT WHO HAVE OBTAINED A SPECIAL COMMISSION TO ENFORCE THE <br />PROVISIONS OF CHAPTER 20. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Ladewski <br />reported that the Public Safety Committee had met on this bill and recommends this to <br />the Council favorable. Kathy Dempsey, Director of Code Enforcement made the <br />presentation. She indicated this bill that <br />bill would allow inspectors from The Code Enforcement Department to issue parking <br />citations for violations during snow removal conditions. Council Member Slavinskas <br />made a motion to recommend this bill to the Council favorable, seconded by Council <br />
