NOVEMBER 13, 1995
findings required pursuant to I.C. 6 -1.1- 12.1 -2 have been met, and that Habitat for
Humanity's properties located at:
2208 West Indiana Avenue
1616 South Phillipa Street
1802 South Phillipa Street
1819 South Phillipa Street
are declared residentially distressed areas.
SECTION IV. This Resolution shall be in full force and effect from and after
its adoption by the Common Council and approval by the Mayor.
/s/ Eugene Ladewski
Member of the Common Council
A public hearing was held on the resolution at this time. Council Member Kelly made
a motion to amend this bill, as on file with the City Clerk, seconded by Council
Member Washington. Council Member Coleman made a motion to amend the motion by
reading the new section, as follows: "The Council further exercises its authority
pursuant to I.C. 6 -1.1- 12.1- 11.3(c) and waives certain compliance requirements with
such waiver taking place after public hearing. The Council further finds that each
of the additional findings required pursuant to I.C. 6 -1.1- 12.1 -2 have been met, and
that Habitat for Humanity's properties located at: 2208 West Indiana Avenue, 1616
South Phillipa Street, 1802 South Phillipa Street, 1819 South Phillipa Street, are
declared residentially distressed areas. ", and the old section 3 is to be renumbered
to Section 4, seconded by Council Member Slavinskas. The motion carried. Council
Member Luecke indicated that the purpose of the amendment is to make the abatement
legal, and these homes have already been built, this has been discussed by the
Council and the Council understands the waiver. Mike Urbanski, 14299 Pine Road,
indicated that Habitat is a blitz program with a lot of concentration in the Rum
Village area. He indicated that abatement should not be requested after the fact,
however, they were requesting this only because it was for Habitat. Council Member
Coleman indicated that the benefit of tax abatement for the properties involved in
this resolution would accrue directly to the homeowner. Council Member Coleman made
a motion to adopt this resolution, as amended, seconded by Council Member Puzzello.
Council Member Luecke indicated that Habitat fills all of the goals for a
residentially distressed area, and the Council can make this distinction, but he did
not believe tax abatement should be offered in this case. The resolution was
adopted by a roll call vote of eight ayes and one nay (Council Member Luecke.)
Council Member Slavinskas made a motion to combine public hearing on the next two
resolutions, seconded by Coleman. The motion carried.
RESOLUTION NO. 2300 -95 A RESOLUTION CONFIRMING THE
RESOLUTION DESIGNATING CERTAIN
SOUTH BEND, INDIANA, COMMONLY
AN ECONOMIC REVITALIZATION AREA
PERSONAL PROPERTY TAX ABATEMENT
- MOLDING PRODUCTS DIVISION
ADOPTION OF A DECLARATORY
AREAS WITHIN THE CITY OF
CNOWN AS 1545 S.
