Kernan Common Council County -City Building South Bend, Indiana 46601 Dear Council Members: In accordance with Ordinance No. 6976 -81, the following recommendation is being submitted to the Common Council con - cerning the petition filed by the St. Joseph County Board of Commissioners for the vacation of several alleys in the Olive/ Sample Overpass area. Favorable comments have been received by the Board from the Engineering Department, Area Plan Commission and Community Development Department for vacation of the above mentioned public rights -of -way. A public hearing was held on December 20, 1982, by the Board concerning the proposed vacation. Abutting property owners to Alley No. 9 as shown on the attached map raised con- cern over the vacation of that alley. As a result and following comments from Mr. Robert Richardson, County Engineer, that it was not imperative Alley No. 9 be vacated at this point, the Board recommended deletion of Alley No. 9 from the vacation proposal. A copy of the excerpts of minutes from that public hearing is enclosed herein. The Board of Works, therefore, recommends vacation of Alley Nos. 1, 2, 3, 4, S, 6, 7, 8, 10, 11 and 12 as shown on the attached map, SUBJECT TO ANY AND ALL UTILITY EASEMENTS.
