(2) All structures and all lines, equipment and <br />connections in, over, under and upon streets, <br />sidewalks, alleys and other public ways and <br />public places in the City, whereever situated or <br />located, shall at all times be kept and <br />maintained in a safe, suitable, substantial <br />condition and in good order and repair. <br />(3) The signal of any television or radio station <br />carried on the franchisee's CATV system shall be <br />carried without material degradation in quality <br />or color within the limits imposed by the <br />technical state of the art and as set forth by <br />the FCC. <br />(4) The franchisee shall maintain an office in the <br />City or within four miles of the limits thereof, <br />staffed with one or more agents or employees at <br />all times, and shall have sufficient employees to <br />provide safe, adequate and proper service for its <br />facilities. The franchisee's office shall be open <br />during normal business hours five days a week and <br />shall have adequate local telephone service and <br />staffing so that complaints and requests for <br />repairs or adjustments may be received by said <br />office 24 hours per day. <br />(5) The franchisee shall grant to the City, free of <br />expense, joint use of any and all poles owned by <br />it for any compatable and proper municipal pur- <br />poses, insofar as it may be done without inter- <br />fering with the free use and enjoyment of the <br />franchisee's own wires and provided that all such <br />joint use shall be in full compliance with all <br />rules, regulations and requirements enacted upon <br />the franchisee and provided that it shall be in <br />accordance with the provisions of the National <br />Electrical Safety Code prepared by the National <br />Bureau of Standards and the National Electric <br />Code of the National Board of Fire Underwriters <br />affecting electrical installations which may be <br />presently in effect or future changes thereto. <br />(6) The franchisee shall undertake any and all con- <br />struction and installation necessary to keep <br />current with the latest development in the state <br />of the art of CATV, whether with respect to <br />increasing channel capacity, developing new <br />services, instituting more extensive two -way <br />service, or otherwise, whenever possible in the <br />light of the franchisee's financial condition <br />and the developmental status of new technology. <br />(7) In areas of the City having telephone lines and <br />electrical and utility lines underground, whether <br />required by other sections of this Code or not, <br />any or all CATV lines, cables, and wires shall be <br />underground. Existing poles for electric and <br />communication purposes shall be utilized whereever <br />possible, and underground installation even when <br />not required shall be preferable to the placing of <br />additional poles. Poles shall not be installed <br />for the sole purpose of supporting CATV installa- <br />tions without written justification to <br />and approval by the Board. The Board may require <br />wires crossing streets to be placed underground if <br />there are no overhead wires at the crossing. <br />2 <br />
