CITY ATTORNEY <br /> November 6,2024 <br /> South Bend Common Council <br /> 227 West Jefferson Blvd,Suite 441 S <br /> South Bend,Indiana 46601 <br /> Re:Proposed Ordinance Establishing a Merit Board <br /> Honorable Council Members, <br /> The South Bend Police Department is requesting the establishment of a merit system for the Police <br /> Department pursuant to I.C. §36-1-4-14 and in relevant parts I.C.§36-8-3.5-1.The Police Merit Board will <br /> have the power of appointment,promotion,demotion,disciplinary action,and dismissal of members of the <br /> department. If a merit system is not established by December 31,2024,I.C. 36-8-3.5-5.5 imposes a merit <br /> system under that chapter. It is the Department's desire with the support of the Fraternal Order of Police <br /> Lodge#36 (FOP)that a merit system be established under I.C. §36-1-4-14 prior to December 31,2024.The <br /> South Bend Police Department is requesting the Common Council's review and approval. <br /> This proposed ordinance has been thoroughly reviewed by the City Legal Department,the Police <br /> Department,the FOP,and the Mayor's office.
