All rights reserved. Page 2 <br />and liability reserve fund created by the City of South Bend, Ordinance #6657-79, <br />pursuant to Indiana Code 34-13-3-4, as amended from time to time. Under said statute, <br />the City’s liability is limited to: <br />1) Seven hundred thousand dollars ($700,000) for a cause of action that accrues on <br />or after January 1, 2008; and <br />2) Five million dollars ($5,000,000) for injury to or death of all persons in that <br />occurrence; and <br />3) A governmental entity or an employee of a governmental entity acting within the <br />scope of employment is not liable for punitive damages. <br /> <br />B. Additional Insureds: <br />The following individuals or entities are to be listed on Owner’s general liability policies of insurance as <br />additional insureds: <br /> <br /> <br />a. <br /> <br /> <br />[ ] <br /> Engineer <br /> <br /> <br />b. <br /> <br /> <br />[ ] <br /> Engineer’s Consultant <br /> <br /> <br />c. <br /> <br /> <br />[ ] <br /> Engineer’s Consultant <br />d. [ ] <br /> [other] <br /> <br />During the term of this Agreement the Engineer shall notify Owner of any other Consultant to be listed as an <br />additional insured on Owner’s general liability policies of insurance. <br />The Owner shall be listed on Engineer’s general liability policy as provided in Paragraph 6.05.A. <br />
