<br />CITY OF SOUTH BEND <br />STUDEBAKER NATIONAL MUSEUM <br />SKYLIGHT REPLACEMENT GUARANTEES AND WARRANTIES 01740-1 <br />SECTION 01740 - GUARANTEES AND WARRANTIES <br /> <br />A. General <br /> <br />1. Summary: <br /> <br />a. Provide guarantees and warranties as defined in the Scope of Work XIV. Warranty. <br /> <br />b. Disclaimers and Limitations: Manufacturer's disclaimers and limitations on product <br />warranties do not relieve the Contractor of the warranty on the work that <br />incorporates the product, nor does it relieve the suppliers, manufacturers and <br />subcontractors required to countersign special warranties with the Contractor. <br /> <br />2. Warranty Requirements: <br /> <br />a. When correcting warranted work that has failed, remove and replace other work that <br />has been damaged as a result of such failure or that must be removed and replaced <br />to provide access for a correction of warranted work. <br /> <br />b. When work covered by warranty has failed and been corrected by replacement or <br />re-building, reinstate the warranty by written endorsement. <br /> <br />c. Upon determination that work covered by warranty has failed, replace or re-build the <br />work to an acceptable condition, complying with requirements of the Contract <br />Documents. The Contractor is responsible for cost of replacing or re-building <br />defective work regardless of whether the Owner has benefitted from use of the work <br />through a portion of its anticipated useful service life. The Contractor shall be <br />responsible for all costs of the replacement. <br /> <br />d. Written warranties made to the Owner are in addition to implied warranties and shall <br />not eliminate the duties, obligations, rights and remedies otherwise available under <br />law, nor shall warranty period be interpreted as limitations on time in which the <br />Owner can enforce such duties, obligations, rights or remedies. <br /> <br />e. The Owner reserves the right to refuse to accept work for the project where a <br />special warranty, certification or similar commitment is required. <br /> <br />3. Submittals: Submit written guarantees and warranties to the Architect prior to the date of <br />Certificate for Substantial Completion. This submission shall include Contractor's warranty <br />on all work covered by the project, along with copies of warranties specified elsewhere in the <br />Construction Documents for equipment and systems. The warranty period for this project <br />shall not begin until certification for final project acceptance has been made by the <br />Contractor and approved by the Architect. <br /> <br /> <br /> <br />END OF SECTION 01740 <br />
