ORDINANCE NO. <br />AN ORDINANCE APPROVING THE SALE OF A PORTION OF <br />VOORDE PARK DECLARED TO BE EXCESS PARK PROPERTY NOT <br />SET ASIDE BY STATE OR CITY LAW FOR PUBLIC PURPOSES <br />STATEMENT OF PURPOSE AND INTENT: <br />The Board of Park Commissioners, at its meeting conducted on <br />August 2, 1983, determined that the following parcel of park property <br />in Voorde Park was real estate no longer needed for park property and <br />was not set aside by State or City law for public purposes: <br />A parcel of land being a part of the Northwest <br />Quarter of the Southeast Quarter of Section 33, <br />Township 38 North, Range 2 East, and a part of the <br />City of South Bend, St. Joseph County, Indiana being <br />more particularly described as follows, viz: <br />Commencing at the Northwest corner of the Southeast <br />Quarter of said Section 33; thence South 0 °- 01' -14" <br />West along the west line of said Southeast Quarter of <br />Section 33, a distance of 889.84 feet; thence South <br />89 °- 40' -09" East, along the South Right -of -way line of <br />Voorde Drive and its projection, a distance of 254.00 <br />feet to the place of beginning for this description; <br />thence continuing South 89 °- 40' -09" East, along said <br />South right -of -way, a distance of 213.47 feet; thence <br />South 0 °- 19' -51" West, a distance of 407.56 feet to <br />the North right -of -way line of Keller Street; thence <br />North 89 °- 58' -08" West, along said North right -of -way <br />line, a distance of 213.47 feet; thence North <br />0 °- 19' -51" East, along the East line of a parcel of <br />land conveyed to Gibbs Wire and Steel Company, Inc. by <br />warranty Deed recorded in Book 815, Page 594 in the <br />Office of the Recorder of St. Joseph County, Indiana, <br />a distance of 408.68 feet to the place of beginning <br />containing 2.000 Acres more or less less. <br />Subject to any easements, covenants or restrictions <br />of record. <br />The Board of Park Commissioners has resolved that said real <br />estate be sold and disposed of to the advantage and best interests of <br />the City of South Bend, Indiana, and the proceeds of such sale be <br />credited to the Department of Public Parks pursuant to State statute, <br />and has, therefore, given notice of and conducted a public hearing <br />upon the desirability of offering said real estate for sale; and <br />subsequent to the public hearing conducted on August 2, 1983, <br />arrangements were completed for a joint appraisal of said real estate <br />per I.C. 36- 1 -11 -4, which said appraisal has been completed. <br />The Mayor of the City of South Bend, pursuant to I.C. <br />36- 1 -11 -3, has given his approval of the sale of said real estate, <br />which approval is dated August 30, 1983. I.C. 36- 10 -4 -18 requires <br />that the Board of Park Commissioners obtain the approval of the city <br />legislative body prior to advertising the real estate for sale. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA, as follows: <br />SECTION 1. The sale of the parcel of real estate in Voorde <br />Park designated on August 2, 1983, by the Board of Park Commissioners <br />as excess park property, no longer needed for park purposes and not <br />set aside by State or City law for public purposes, is hereby <br />approved. <br />SECTION 2.
