M CRUZ MICHUDA CONSTRUCTION CONSTRUCTION JOINT VENTURE MICHUDA-CRUZ Indiana JV LLC 115 S Court St., Suite E Crown Point, IN 46307 Alcohol and Substance Abuse Policy MICHUDA — CRUZ Indiana JV LLC is committed to providing a safe work environment and to maintaining the health and well-being of its employees. Illegal drugs and alcohol use seriously jeopardizes our commitment to creating a safe work environment. MICHUDA-CRUZ Indiana JV LLC (Members: Michuda Construction Inc. and CRUZ Management Group LLC) prohibits the following by employees working on MICHUDA-CRUZ Indiana JV LLC projects or while on Michuda-CRUZ Indiana JV LLC Projects: • Use of illegal drugs • Being under the influence of drugs and alcohol • Possession, control, purchase, sale, transportation, or distribution of illegal drugs, drug Paraphernalia, alcohol, or alcohol products. If an employee is involved in an incident resulting in an injury (a recordable or non -recordable injury requiring medical attention) the employee must submit to a post -incident drug/alcohol test. MICHUDA-CRUZ Joint Venture LLC (Michuda Construction, Inc., and CRUZ Management Group LLC) reserves the right to a post -incident drug/alcohol test at its discretion. Per Indiana Public Work Proiect Act: IC 4-13-18-5: MIC14UDA-CRUZ Indiana JV LLC (Member: Michuda Construction, Inc.) is part of an Indiana Collective Bargaining Agreement with Michiana Builders Association. Michiana Builders Association signed an agreement on behalf of Michuda Construction Inc. with IKOR Regional Councils for LOCALS 413 (South Bend and Local 615 (Zones 1 and 2) , as well as with Laborers (International Union of North America, State of Indiana District Council, Local 645. The Drug Testing Program for the Michiana Builders Association and IKOR Carpenters Regional Councils for LOCALS 413 and Local 615 Term of Agreement (June 1, 2022, to May 31, 2025), can be located under Article XVIII, "Drug Testing Program " on Pages 21-22. (Union Document attached). The Drug Testing Policy for the Michiana Builders Association and the Laborers (Internation Union of North America, State of Indiana District Council, Local Bargaining Association's Laborers Local 645 Term of Agreement (June 1, 2023 to May 31, 2026), can be located under Article XVIII, "Drug Testing Program" Pages 21-22. (Union Document attached). As listed in the attached Michiana Builders Association and the IKOR Carpenters Local 413 South Bend and Indiana Laborers District Council Local 645 South Bend utilize and BCRC Building & Construction Resource Center, Inc.) to implement Policy and Testing. A copy of the BCRC's Policy, Testing, etc. (Copy of BCRC Policy is attached).
