All rights reserved. <br />AGREEMENT <br />BETWEEN OWNER AND ENGINEER <br />FOR <br />PROFESSIONAL SERVICES <br />THIS IS AN AGREEMENT effective as of _________________________ (“Effective Date”) between <br />Board of Public Works, City of South Bend, Indiana ("Owner") and <br />Jones Petrie Rafinski ______________________________________________________(“Engineer”). <br />Owner's Project, of which Engineer's services under this Agreement are a part, is generally identified as <br />follows: <br />Dylan Drive Lighting Update _______________________________________________(“Project"). <br />Engineer’s Services under this Agreement are generally identified as follows: <br />Design Services, Construction Plans and Specifications, Bidding or Negotiating Phase, and Construction <br />Administration as further described in the attached Professional Consulting Services for City of South <br />Bend Dylan Drive Lighting Update Proposal dated Sept 16, 2024. Please refer to the attached document. <br />Owner and Engineer further agree as follows: <br />1.01 Basic Agreement and Period of Service <br />C.If the Project includes construction-related professional services, then Engineer's time for <br />completion of services is conditioned on the time for Owner and its contractors to complete <br />construction not exceeding _N/A_ months. If the actual time to complete construction exceeds the <br />A.Engineer shall provide, or cause to be provided, the services set forth in this Agreement. If <br />authorized by Owner, or if required because of changes in the Project, Engineer shall furnish <br />services in addition to those set forth above. Owner shall pay Engineer for its services as set forth <br />in Paragraphs 7.01 and 7.02. <br />B.Engineer shall complete its services within a reasonable time, or within the following specific time <br />period: [It is the desire of the City to have 100% plans and specifications completed by December <br />2024. JPR will modify prior plans from 2019-2020 and be ready to bid in January 2025. JPR will <br />organize and run a pre-bid meeting with potential contractors. <br />C.
