REGULAR MEETING September 23, 2024 Erik Horvath, Public Works Director with offices on the 131h floor of the County-City Building, stated that the legal description for Substitute Bill No. 45-24 had been corrected to better describe the vacation. Steven Woolley, petitioner, 902 South Michigan Street, South Bend IN 46601, stated that vacating the alleys would allow for more space on his property. Councilmember Lee held the public hearing, and nobody spoke. Councilmember Tomas Morgan stated that Substitute Bill No. 45-24 was submitted before the new alley vacation requirements were enacted. Councilmember Warner stated that both of these alleys are referred to as paper alleys. This means no physical alley exists; the alleys only exist within the City's records. Councilmember Tomas Morgan motioned to send Substitute Bill No. 45-24 to the Full Council with a favorable recommendation,which was seconded by Council Vice President Niezgodski and carried by a vote of eight (8) ayes with one (1) Councilmember absent. White—Aye Councilmember Rachel Tomas Morgan—Aye 46-24 PUBLIC HEARING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, TO VACATE THE FIRST EAST/WEST BOUND ALLEY SOUTH OF PRAIRIE AVENUE, BETWEEN GLEN STREET AND NORTH/SOUTH ALLEY EAST OF BROOKFIELD STREET (SUBSTITUTE) Clerk Tirado read the bill to the Council for its second (2"d) reading. Council Vice President Niezgodski motioned to accept Substitute Bill No. 46-24, which was seconded by Councilmember Gooden-Rodgers and carried via a vote by voice. After the second (2°d) reading, Councilmember Lee requested the committee report. Council Vice President Niezgodski stated that Substitute Bill No. 46-24 went before the Public Works and Property Vacation Committee and comes with a favorable recommendation. Councilmember Lee requested that the petitioner(s) state their name and address and share key points before the Council. Robert Gundeck, petitioner, 1986 Prairie Avenue, South Bend IN 46613, stated that he would like to extend his backyard and vacate the alley due to security concerns. Councilmember Lee held the public hearing, and nobody spoke. Councilmember White motioned to send Substitute Bill No. 46-24 to the Full Council with a favorable recommendation, which was seconded by Council President McBride and carried by a vote of eight(8) ayes with one(1) Councilmember absent.
