REGULAR MEETING FEBRUARY 26, 1996 <br />Hurst, President of Management Consortium, made the presentation <br />for the resolution. He indicated they propose to build a four <br />story, 150 room, full service hotel which will overlook the <br />Blackthorn Golf Course. Ann Kolata, Redevelopment spoke in favor <br />of this resolution. Council Member Coleman made a motion to adopt <br />this resolution, seconded by Council Member Hosinski. The <br />resolution was adopted by a roll call vote of nine ayes. <br />RESOLUTION NO. 2341 -96 A RESOLUTION CONFIRMING THE ADOPTION <br />OF A DECLARATORY RESOLUTION <br />DESIGNATING CERTAIN AREAS WITHIN THE <br />CITY OF SOUTH BEND, INDIANA, <br />COMMONLY KNOWN AS 3702 W. SAMPLE <br />STREET, SOUTH BEND, INDIANA, 46619, <br />TO BE AN ECONOMIC REVITALIZATION <br />AREA FOR PURPOSES OF A FIVE (5) YEAR <br />PERSONAL PROPERTY TAX ABATEMENT FOR <br />CHERRY ROLLER, INC. <br />WHEREAS, the Common Council of the City of South Bend, Indiana, has <br />adopted a Declaratory Resolution designating certain areas within <br />the City as Economic Revitalization Areas for the purpose of tax <br />abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly <br />known as 3702 W. Sample, South Bend IN, and which is particularly <br />described as follows: <br />That part of the northeast quarter of 16,T. 37 N, R 2E, City <br />of South Bend, St. Joseph County, which is described as: From <br />the Northwest Corner of the East half of the Northeast quarter <br />of said Section measure South 90 deg. 00 min. 00 sec. West <br />along the North line of said Section 630 ft. and South 00 deg. <br />02 min. 31 sec. West along the North line of said Section 630 <br />ft. and South 00 deg. 02 min. 31 sec. E 40.00 ft. and north 90 <br />deg. 00 min. 00 sec. East 300.02 ft (300.00 ft. Record) and <br />South 00 deg. 04 min. 00 sec. West 579.33 ft. (S. 00 deg. 01 <br />min 52 sec. W., 59 min, 13 sec. East 13.745 Ft. Record) and <br />South 00 deg. 00 min 38 sec. east 280.27 ft. to the Point of <br />Beginning of this description, thence South 89 deg. 55 min. 49 <br />sec. West along the North line of Industrial Ave. (now <br />Vacated). 159.99 ft. thence South 00 deg. 03 min. 24 sec. West <br />400.60 ft,; thence south 89 deg. 55 min 41 sec. East along the <br />northerly line of the New Jersey, Indiana and Illinois <br />Railroad 289.00 ft., thence north 00 deg. 03 min. 24 sec. East <br />363.03 ft (N 00 deg. 01 min 48 sec. E. 364.55 ft. Record) ; <br />thence North 89 deg. 56 min. 24 sec. west 128.96 ft. (N 89 <br />deg. 55 min 00 sec. 128.885 ft., Record). thence North 00. deg. <br />00 min 38 sec. West 36.00 ft. (N 00 deg. 02 min 16 sec. W. <br />Record) to the point of beginning. Containing 2.5472 acres. <br />with said real estate having the following Key No. 180 811 242 1503 <br />as an Economic Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the <br />public hearing before the Council has been published pursuant to <br />Indiana Code 6 -1.1- 12.1 -2.5; and <br />WHEREAS, the Council held a public hearing for the purposes of <br />hearing all remonstrances and objections from interested persons; <br />and <br />WHEREAS, the Council has determined that the qualifications for an <br />economic revitalization area have been met. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of <br />South Bend, Indiana, as follows: <br />SECTION I.
