Terrns and Conditions Warranty: Rooftech Construction, LLC warranties workmanship for the lif'etime of each individual material under normal conditions. Ice damming, wind driven rain, pipes installed in attic spaces, and other circumstances beyond our control, are not covered. Materials installed are not to be altered by any other contractor, company or individual ln the event it has been altered b5, anyone other than Roo{'tech Construction LLC; the warranty will be l'oided. Shingles and materials are guaranteed by their manufacturer. Warranties for parts or materials are subject to the manufacturer terms on such products. Extended manufacturer warranties are ofadditional cost and will be discussed at the time ofpurchase. To make a claim against Rooftech Construction, T T,C's rvarranty, the customer must provide Root'tech Construction, LLC rvritten notice, by certified mail, describing the alleged defect. Rooftech Construction, LLC will provide the customer with a written response within 21 days of the day Rooftech Construction, T .T .C receives the customer's initial written notice of an alleged defect. Rooftech Construction, LLC may offer to remedy the defect, pa)r the claim, or dispute the claim. Rooftech Construction, LLC rvill not honor a claim unless customer first gives Rooftech Construction, LLC notice in accordance with this section. Unless explicitly stated, repairs are NOT covered by any extended workm.anship warranty. Scope of work: Rooftech Construction, Il-C will provide services as described in the attached estimate. All duties will be performed in accordance with current building codes and regulations. Rooftech Construction, LLC will provide all services, materials, Iabor, tools, and equipment needed lbr completion of Iisted duties. Payment Terms: If the customer resides in the address where duties are to be performed a.t, no payment is due upon the acceptance ofestimate. Ifthe customer does not reside in the address where duties rvill be perfbrrned, 50% ofthe contracted project's price is due at the time of contract signing. The balance of all contracts are due imrnediately upon project completion. All checks will be made payable to Rooftech Construction, LLC. In the event of nonpayment of the balance N,ithin 7 days ofjob completion, the customer must pay to Rooftech Construction, T LC an additional late charge of 10% of the unpaid balance for the first 45 days. An5, rsmririr* unpaid balance after 45 days will be turned over to collections. AIl. resulting collection and court costs r,r'ill be paid by the customer. The custorner firrther agrees that they rvill be charged a $50.00 fee for each dishonored bank check. Credit card payments are subject to a $% price increase due to processing fees. Cancelation: Ifthe customer chooses to cancel this agreement after signing, a $2,000.00 penalty fine or 10% ofthe total contract, whichever is greater, is due imrrrediately. In addition., the customer i.s liable for all expenses related to their project (i.e., materials, permitting, labor, etc.) Disputes: In the event ofa claim being brought to enforce rights under this contract, Rooftech Construction, LLC shall be entitled to recover its costs and expenses, i.ncluding but not limited to reasonable attorneys'fees, incurred in the event of, but not limited to, breach ofthis contract. Work Change Order: In the even.t of any deviation f'rom the above estirnate involving an alteration in the scope of work, or any additional costs, Rooftech Construction, t,LC will attempt to notily the customer. Due to specificjob-related variables, work change orders will be verbal and/or rvritten. Work change orders do not require a signed document to be enforceable. No jobs can be subcontracted under Rooftech Construction, LLC without rvritten consent of company upper management. Unforeseen Conditions: Any duties not indicated in the plans or specifications of the above listed contracted duties, that must be added, repaired, or replaced as a result ofhidden, concealed or changed conditions, or that is required fbr cornpliance with building reguiations andlor codes, will result in a WOBK CHANGE ORDER. Work change orders will result in, but are not limited to, additional services, materials, and labor. All of whieh will incur additional costs that will be paid in full by the OWNER/CUSTOMER, subject to the terms and conditions of this contract. Conditions: This proposal is valid for 30 da5,s. Rooftech Construction, LLC reserves the right to withdraw this proposal or re-quote the project ifcontract acceptance is beyond 30 days from the date oforiginal estirnation. All contracts must be signed before work is commenced. Rooftech Construction, LLC reserves the right to refuse services at an1, tirne prior to commencement of listed duties. Accessories: When satellites, antennas, or other unique accessories are present, they will have to he removed to correctly install new materials. During such events, Rooftech Construction, LLC is not responsible for signal loss and/or the cost re- instailation ofsuch accessories. Rooftech Construction, LLC is not liable for existing gutter damage that was presentprior to the cornmencement ofcontracted duties. In situations where gutters need to be removed to complete contracted duties, Rooftech Construction, T,LC cannot guarartee that gutters rvill be salvageable, but every attempt q.'ill be made to preserve their origfual condition. Driveway/Parking Surfaces: During the compietion of contracted duties heav-v equipment such as, but not limited to, portable cranes, boom trucks, dumpsters, and material delivery vehicles will have to utilize the properties driveway andy'or parking lots. Preventative measures will be implemented to attempt to protect driveways and/or parking lots. If cracks or damages do occur, resulting from such equipment, Rooftech Construction, LLC IS NOT LIABLE FOR THE COST OF REPAIR OR REPI"ACEMENT, Customer Initials Date Page 3 of 3
