REGULAR MINUTES JUNE 23, 1997 <br />This being the time heretofore set for public hearing on the <br />above bill, proponents and opponents were given an opportunity to <br />be heard. Council Member Broden reported that the Zoning and <br />Annexation Committee had met on this bill and recommended it to <br />the Council favorable, as amended. Council Member Hosinski made <br />a motion to accept the substitute bill on file with the City <br />Clerk, seconded by Council Member Varner. The motion carried. <br />Jim Voll, Area Plan, made the presentation for the bill. He <br />indicated this was an Area Plan initiated bill to rezone office <br />properties some of which are legal non - conforming uses. He <br />reported that non - conforming uses cannot be expanded or rebuilt <br />if destroyed, and the PHC zoning will make existing offices <br />permitted uses. Council Member Hosinski made a motion to <br />recommended this bill to the Council favorable, as amended, <br />seconded by Council Member Pfeifer. The motion carried. <br />BILL NO. 43 -97 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY <br />LOCATED AT 1881 NORTH IRONWOOD ROAD, IN THE CITY <br />OF SOUTH BEND, INDIANA <br />This being the time heretofore set for public hearing on the <br />above bill, proponents and opponents were given an opportunity to <br />be heard. Council Member Broden reported that the Zoning and <br />Vacation Committee had met on this bill and recommended it to the <br />Council favorable. Jim Voll, Area Plan, advised that the <br />petitioners were requesting a change from 110" office to "C" <br />Commercial in order to allow the existing office and expansion of <br />an existing supermarket. He gave the staff report, and reported <br />that the Commission had given this rezoning a favorable <br />recommendation. George Weber, Architect, made the presentation <br />for the bill. He indicated this rezoning was being requested <br />primarily for the purpose of bring the zoning in conformance. He <br />indicated Martins supermarket is planning to expand their <br />building at this location. Council Member Aranowski made a <br />motion to recommend this bill to the Council favorable, seconded <br />by Council Member Sniadecki. The motion carried. <br />Council Member Kelly made a motion to combine public hearing on <br />Bill Nos. 49 and 52 -97, seconded by Council Member Hosinski. The <br />motion carried. <br />BILL NO. 49 -97 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND ESTABLISHING A NEW SCHEDULE OF RATES AND <br />CHARGES FOR SERVICES RENDERED BY THE CITY OF SOUTH <br />BEND WATER WORKS AND THE AMENDING OF CHAPTER 17, <br />ARTICLE 4, SECTIONS 17 -45 AND 17 -46 OF THE SOUTH <br />BEND MUNICIPAL CODE <br />BILL NO. 52 -97 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, CONCERNING THE CONSTRUCTION OF <br />IMPROVEMENTS TO THE MUNICIPAL WATERWORKS OF THE <br />CITY OF SOUTH BEND, INDIANA; AUTHORIZING THE <br />ISSUANCE OF REVENUE BONDS FOR SUCH PURPOSE IN THE <br />PRINCIPAL AMOUNT NOT TO EXCEED TWENTY -TWO MILLION <br />FIVE HUNDRED THOUSAND DOLLARS ($22,500,000); <br />ADDRESSING OTHER MATTERS CONNECTED THEREWITH, <br />INCLUDING THE ISSUANCE OF NOTES IN ANTICIPATION OF <br />BONDS; AND REPEALING ORDINANCES INCONSISTENT <br />HEREWITH <br />This being the time heretofore set for public hearing on the <br />above bills, proponents and opponents were given an opportunity <br />to be heard. Council Member Sniadecki reported that the <br />Utilities Committee had met on these bills and recommended them <br />to the Council favorable. Mayor Luecke indicated we were <br />planning for the orderly growth of the City and being able to <br />provide a proper water supply to our customers.
