The motion carried. <br />BILL NO. 31 -97 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY <br />LOCATED APPROXIMATELY 195' NORTHEASTERLY OF THE <br />INTERSECTION OF PRAIRIE AVENUE AND LOCUST ROADS ON <br />THE SOUTHERLY SIDE OF PRAIRIE AVENUE IN THE CITY <br />OF SOUTH BEND, INDIANA <br />This being the time heretofore set for public hearing on the <br />above bill, proponents and opponents were given an opportunity to <br />be heard. Council Member Pfeifer made a motion to accept the <br />substitute bill on file with the City Clerk, seconded by Council <br />Member Aranowski. The motion carried. Council Member Broden <br />reported that the Zoning and Vacation Committee had met on this <br />bill and recommended it to the Council favorable, as amended. <br />John Byorni, assistant director of Area Plan, indicated the <br />petitioners were requesting this change in zoning to allow for <br />retail establishments. He reported that this property had been <br />rezoned for this purpose before, however, the zoning had <br />reverted. He indicated the Area Plan Commission recommends this <br />to the Council favorable. Bernard Feeney, land surveyor, made <br />the presentation for the bill. He indicated this will be the <br />third time the Council has approved this zoning for this <br />property, however, this time construction will begin. Council <br />Member Varner made a motion to recommend this bill to the Council <br />favorable, as amended, seconded by Council Member Sniadecki. The <br />motion carried. <br />BILL NO. 32 -97 A BILL AMENDING AND SUPPLEMENTING CHAPTER 21, <br />ZONING, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH <br />BEND, INDIANA, AS AMENDED, BY ADDING TO AND MAKING <br />CERTAIN REVISIONS TO THE ZONING ORDINANCE <br />This being the time heretofore set for public hearing on the <br />above bill, proponents and opponents were given an opportunity to <br />be heard. Council Member Varner made a motion to accept the <br />substitute bill on file with the City Clerk, seconded by Council <br />Member Hosinski. The motion carried. Council Member Broden <br />reported that the Zoning and Vacation Committee had met on this <br />bill and recommended it to the Council favorable, as amended. <br />John Byorni, assistant director of Area Plan, made the <br />presentation for the bill. He reported this was an Area Plan <br />initiated petition, amending the municipal code by adding new <br />definitions, establishing new permitted uses and special <br />exceptions in various zoning districts, revise the "A" <br />Residential District, the Historic Preservation regulations and <br />the sign regulations. He indicated the permitted uses and <br />special exceptions will allow for family type restaurants that <br />serve liquor to operate in the City. He reported that the Area <br />Plan Commission sends this to the Council favorable. Council <br />Member Pfeifer made a motion to recommend this bill to the <br />Council favorable, seconded by Council Member Sniadecki. The <br />motion carried. <br />BILL NO. 44 -97 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: <br />TUDOR LANE FROM THE EAST RIGHT -OF -WAY OF WOODMONT <br />STREET (OR DRIVE) APPROXIMATELY 115 FEET EAST TO <br />DEAD END AND A WIDTH OF 50 FEET. PART LOCATED IN <br />TWYCKENHAM HILLS SECTION "H ", CITY OF SOUTH BEND, <br />ST.
