REGULAR MEETING JUNE 9, 1997 order to expand their business. Council Member Broden made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Varner. The motion carried. BILL NO. 31 -97 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED APPROXIMATELY 195' NORTHEASTERLY OF THE INTERSECTION OF PRAIRIE AVENUE AND LOCUST ROADS ON THE SOUTHERLY SIDE OF PRAIRIE AVENUE IN THE CITY OF SOUTH BEND, INDIANA This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Pfeifer made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Aranowski. The motion carried. Council Member Broden reported that the Zoning and Vacation Committee had met on this bill and recommended it to the Council favorable, as amended. John Byorni, assistant director of Area Plan, indicated the petitioners were requesting this change in zoning to allow for retail establishments. He reported that this property had been rezoned for this purpose before, however, the zoning had reverted. He indicated the Area Plan Commission recommends this to the Council favorable. Bernard Feeney, land surveyor, made the presentation for the bill. He indicated this will be the third time the Council has approved this zoning for this property, however, this time construction will begin. Council Member Varner made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Sniadecki. The motion carried. BILL NO. 32 -97 A BILL AMENDING AND SUPPLEMENTING CHAPTER 21, ZONING, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED, BY ADDING TO AND MAKING CERTAIN REVISIONS TO THE ZONING ORDINANCE This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Varner made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Hosinski. The motion carried. He reported this was an Area Plan initiated petition, amending the municipal code by adding new definitions, establishing new permitted uses and special exceptions in various zoning districts, revise the "A" Residential District, the Historic Preservation regulations and the sign regulations. He indicated the permitted uses and special exceptions will allow for family type restaurants that serve liquor to operate in the City. He reported that the Area Plan Commission sends this to the Council favorable. BILL NO. 44 -97 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: TUDOR LANE FROM THE EAST RIGHT -OF -WAY OF WOODMONT STREET (OR DRIVE) APPROXIMATELY 115 FEET EAST TO DEAD END AND A WIDTH OF 50 FEET. PART LOCATED IN TWYCKENHAM HILLS SECTION "H ", CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard.
