REGULAR MEETING DECEMBER 14, 1998 <br />OFF OF MIAMI HIGHWAY APPROXIMATELY 400 FEET <br />SOUTH OF KERN ROAD <br />This being the time heretofore set for public hearing on the <br />above bill, proponents and opponents were given an opportunity to <br />be heard. Council Member Varner reported that the Public Works <br />and Property Vacation Committee had met on this bill and <br />recommended it to the Council favorable. John Leszczynski, from <br />The Troyer Group, made the presentation for the bill. He <br />reported that when this subdivision was developed they created a <br />number of walkways, and in preparing to subdivide it was <br />determined that there was a need to straighten the west and south <br />borders of Lot 43. He advised that they were requesting this <br />vacation in order to realign the property. Council Member <br />Aranowski made a motion to recommend this bill to the Council <br />favorable, seconded by Council Member Sniadecki. The motion <br />carried. <br />BILL NO. 106 -98 A BILL AMENDING THE ZONING ORDINANCE AND <br />ESTABLISHING AN HISTORIC LANDMARK FOR THE <br />PROPERTY LOCATED AT 1636 LINCOLNWAY WEST, IN <br />THE CITY OF SOUTH BEND, INDIANA <br />This being the time heretofore set for public hearing on the <br />above bill, proponents and opponents were given an opportunity to <br />be heard. Council Member Hosinski reported that the Zoning and <br />Annexation Committee had met on this bill and recommended it to <br />the Council favorable. John Oxian, president of Historic <br />Preservation, made the presentation for the bill. He advised <br />this property is the former South Bend Brewing Association, and <br />at the present time is being used as a consignment and antique <br />shop. He advised that the Commission recommends this building <br />become an historic landmark. Council Member Kelly made a motion <br />to recommend this bill to the Council favorable, seconded by <br />Council Member Aranowski. The motion carried. <br />BILL NO. 103 -98 A BILL OF THE COMMON COUNCIL OF THE CITY OF <br />SOUTH BEND, INDIANA, AMENDING ARTICLE 7, OF <br />CHAPTER 21, ZONING, OF THE SOUTH BEND <br />MUNICIPAL CODE BY THE INCLUSION OF NEW <br />SECTION 21 -130 ENTITLED USE OR DEVELOPMENT <br />WRITTEN COMMITMENTS <br />This being the time heretofore set for public hearing on the <br />above bill, proponents and opponents were given an opportunity to <br />be heard. Council Member Hosinski reported that the Zoning and <br />Annexation Committee had met on this bill and recommended it to <br />the Council favorable. Jim Voll, Area Plan, made the <br />presentation for the bill. He reported this was an Area Plan <br />initiated petition to amend the zoning ordinance to allow written <br />commitments for rezoning. He advised that the Area Plan <br />Commission sends this to the Council with a favorable <br />recommendation. Council Member Coleman made a motion to <br />recommend this bill to the Council favorable, seconded by Council <br />Member Varner. The motion carried. <br />BILL NO. 87 -98 A BILL AMENDING THE ZONING ORDINANCE FOR <br />PROPERTY GENERALLY LOCATED AT 2102 EAST <br />INWOOD ROAD, CITY OF SOUTH BEND, INDIANA <br />This being the time heretofore set for public hearing on the <br />above bill, proponents and opponents were given an opportunity to <br />be heard. Council Member Hosinski reported that the Zoning and <br />Annexation Committee had met on this bill and recommended it to <br />the Council favorable. Jim Voll, Area Plan, made the <br />presentation for the bill. He advised that this was an Area Plan <br />initiated petition to rezone this property to Professional /Health <br />Care. He advised that a site plan is not required. He reported <br />that the Area Plan Commission sends this to the Council with a <br />favorable recommendation.
