BILL NO. 36-24 <br />ORDINANCE NO. 11136-24 <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED <br />5101 NIMTZ PARKWAY COUNCILMANIC DISTRICT NO. 1 IN THE CITY OF <br />SOUTH BEND, INDIANA <br />STATEMENT OF PURPOSE AND INTENT <br />Rezone to I Industrial to allow for professional office use <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />SECTION I. Ordinance No. 10689-19, which ordinance is commonly known as the <br />Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby amended in order <br />that the zoning classification of the following described real estate in the City of South Bend, St. <br />Joseph County, State of Indiana: <br />THAT PART OF THE NORTHEAST, SOUTHEAST, SOUTHWEST, AND <br />NORTHWEST QUARTERS OF SECTION 20, TOWNSHIP 38 NORTH, RANGE 2 <br />EAST, SITUATED IN GERMAN TOWNSHIP, ST. JOSEPH COUNTY, INDIANA AND <br />BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT <br />A MAG NAIL MARKING THE NORTHWEST CORNER OF THE NORTHEAST <br />QUARTER OF SAID SECTION 20; THENCE SOUTH 00° 20' 15" EAST (GEODEDIC <br />BEARING) ALONG THE WEST LINE OF THE NORTHEAST AND SOUTHEAST <br />QUARTERS OF SAID SECTION, A DISTANCE OF 3072.47 FEET TO A CUT "X" <br />MARKING THE NORTHWEST CORNER OF OUTLOT A IN BLACKTHORN <br />INDUSTRIAL FIRST MINOR SUBDIVISION, SAID POINT BEING THE POINT OF <br />BEGINNING; THENCE SOUTH 89° 51' 28" EAST ALONG THE NORTH LINE OF <br />SAID OUTLOT A, A DISTANCE OF 594.00 FEET TO THE NORTHEAST CORNER <br />OF SAID OUTLOT A, SAID POINT ALSO BEING ON THE WEST LINE OF LOT 2 IN <br />SAID BLACKTHORN INDUSTRIAL FIRST MINOR SUBDIVISION; THENCE <br />NORTH 00° 11' 29" EAST ALONG THE WEST LINE OF SAID LOT 2, A DISTANCE <br />OF 499.67 FEET TO A POINT ON THE SOUTH RIGHT-OF-WAY LINE OF <br />INTERSTATE 80/90; THENCE NORTH 89° 51' 36" WEST ALONG SAID SOUTH <br />RIGHT-OF-WAY LINE, A DISTANCE OF 1200.44 FEET; THENCE SOUTH 00° 08' <br />24" WEST ALONG THE EAST LINE OF LOT 8 IN BLACKTHORN CORPORATE <br />OFFICE PARK MINOR SUBDIVISION, A DISTANCE OF 500.00 FEET; THENCE <br />SOUTH 89° 51' 36" EAST ALONG THE NORTH OF SAID LOT 8, A DISTANCE OF <br />605.99 FEET TO A POINT ON THE WEST LINE OF THE SOUTHEAST QUARTER <br />OF SAID SECTION; THENCE NORTH 00° 20' 15" WEST ALONG SAID WEST LINE, <br />A DISTANCE OF 0.35 FEET TO THE PLACE OF BEGINNING. SAID IN PREVIOUS <br />DEED TO CONTAIN 13.772 ACRES, MORE OR LESS. <br />be and the same is hereby established as I Industrial zoning <br />SECTION II. This ordinance is and shall be subject to commitments as provided by <br />Chapter 21-12.070)(7) Commitments, if applicable. <br />SECTION III. This Ordinance shall be in full force and effect from and after its passage <br />by the Common Council and approval by the mayor, and legal publication, and full execution of <br />any conditions or Commitments placed upon the approval. <br />
