Page | 8 <br />Insurance Provider Acknowledgment <br />1.Homeowner acknowledges that they are under contract with Horner Roofing & Siding, LLC. <br />2. Homeowner acknowledges that the funds from the approved insurance scope of work are being applied and paid to the restoration and repair of their home performed by Horner Roofing <br />& Siding, LLC. <br />3. Homeowner acknowledges that they are not committing insurance fraud and/or keeping any approved insurance funds. <br />4. Insurance claims: any person who knowingly, and with intent to defraud or deceive their insurance company, files a statement of claim containing any false, incomplete, or misleading <br />information can be found guilty of a felony and subject to criminal and civil penalties. <br />5. Failure of payment will require Horner Roofing & Siding, LLC to report any default to the state department of insurance for fraud and insurance fraud claims for investigation. Homeowner <br />acknowledges that they may be required to assist with their insurance company during the restoration process. Initial: <br />Restoration Liability Waiver <br />Dear Homeowner, <br />We at Horner Roofing & Siding, LLC recognize that all home improvement projects are a major inconvenience to you. Remodeling Magazine states that the number having an <br />unsatisfied customer is that the customer envisions a different job completion than the contractor. In response to that, we w ould like to offer the following hints and suggestions. These suggestions <br />are designed to minimize problems, eliminate concerns, and ensure that your expectations are the same as ours. <br />1.We will strive to provide you with notice before we start your job. It is important that you remove all breakables from your exterior walls. When siding is installed, we will be hammering <br />on all exterior studs, which may cause vibrations that may shake items off the walls. Horner Roofing & Siding, LLC will not be responsible for any damage caused by improper installation <br />of light fixtures, shelving, furniture, or any other items attached or fastened to any wall or ceiling. <br />2.The aforementioned vibration has, on rare occasions, caused nail pops. If this occurs, it is an indication of a pre-existing problem due to poor installation of your drywall. If you notice <br />this in your home, please note that we will fix the nail pops. We will re-secure the drywall and spackle the nail heads; however, we cannot be responsible for painting. <br />3.Shrubbery - We will strive to the best of our abilities not to have contact with any plants or shrubs However, those plants or shrubs within several feet of the exterior walls may cause a <br />problem. We cannot install siding where we are unable to reach. If there are several plants or shrubs within this vicinity, that you consider irreplaceable, we would suggest that you <br />consider transplanting them as Horner Roofing assumes no liability for damaged shrubs, trees, or bushes. Again, we will make every effort to be as careful as possible <br />4.Screens - During home restoration, large amounts of damaged materials are removed from your home. Many of these materials have sharp, pointed edges. While we make every effort <br />to be as careful as possible, these pieces have the potential of damaging window screens. Therefore, to prevent damage to home screens, the homeowner should remove all screens <br />prior to siding installation. <br />5.Horner Roofing & Siding, LLC will not be responsible for the slight scratching or denting of gutters, skylights, siding, aluminum capping, oil droplets in driveways, hairline fractures in <br />concrete, or damage to plants and shrubbery. If excessive damage is present, an independent experienced mediator will be contacted to determine fault and next course of action. <br />6.If your project includes detaching and resetting your satellite dish or antenna, homeowner agrees that Horner Roofing & Siding, LLC will not be responsible for re-establishing the signal. <br />7.Clean Up - It is our policy to clean up the job site daily. When the old siding is removed, a very large quantity of old nails will fall to the ground. The siding crew will pick these up daily; <br />however, with so many people walking around the house, they may step on a few. Consequently, there will be a small number of nails slightly below the ground, and we recommend <br />caution when walking around the yard barefoot until such a time that you can be reasonably confident that all nails have been removed. Once the job is complete, a thorough examination <br />of the entire job site will involve magnet sweeps and general pick up maintenance to ensure a clean property. <br />8.During the duration of the work, the customer's homeowners insurance will be responsible for any interior damage as long as Horner Roofing has taken appropriate action to protect the <br />roof during the repair of the roof. <br />If you have any questions, please contact customer service at 574-318-0316 or send an email to customerservice@hornerroofing.com. Initial: <br />I have read and understand the above restoration liability waiver. <br />Home Repair: Know Your Consumer Rights <br />As you plan for your home repair/improvement project, it is important to ask the right questions in order to protect your investment. The tips in this fact sheet should allow you to protect yourself and <br />minimize the possibility of a misunderstanding. <br />Avoiding Home Repair Fraud <br /> Please use extreme caution when confronted with the following warning signs of a potential scam: <br />1.Door-to-door salespersons with no local connections who offer to do home repair work for substantially less than the market price. <br />2. Solicitations for repair work from a company that lists only a telephone number or post office box number to contact, particularly if it is an out-of-state company. <br />3. Contractors who fail to provide customer references when requested. <br />4. Persons offering to inspect your home for free. Do not admit anyone into your home unless he or she can present authentic identification establishing his or her business status. When in <br />doubt, do not hesitate to call the person’s employer to verify his or her identity. <br />5.Contractors demanding cash payment for a job or who ask you to make a check payable to a person other than the owner or company name. <br />6.Offers from a contractor to drive you to the bank to withdraw funds to pay for the work. <br />Contracts <br />1.Never sign a contract with blank spaces or one you do not fully understand. If you are taking out a loan to finance the work, do not sign the contract before your lender approves the <br />loan. <br />2. Remember, you have three business days from the time you sign your contract to cancel any contract if the sale is made at your home. The contractor cannot deprive you of this right by <br />initiating work, selling your contract to a lender, or by any other means. <br />3. Homeowners should check with local and county units of government to determine if permits or inspections are required. <br />4. Determine whether the contractor will guarantee his or her work and products. <br />5.Obtain all estimates in writing. <br />6.Do not be induced into signing a contract through high pressure sales tactics. <br />7.Determine whether the contractor has the proper insurance. <br />8. Do not sign a certificate of completion or make a final payment until the work is done to your satisfaction. <br />9.Remember, homeowners should know who provides materials and labor for any work performed on your home. Suppliers and subcontractors have a right to file a lien against your <br />property if the general contractor fails to pay them. To protect your property, request lien waivers from the general contractor. <br />Basic Terms to Include in a Contract <br />1.Contractor’s full name, address, and telephone number. State law requires that persons selling home repair and improvement se rvices provide their customers with notice of any change <br />to their business name or address that occurs prior to the agreed dates for beginning or completing the work. <br />2. A description of the work to be performed. <br />3. Estimated start and completion dates. <br />4. Total cost of work to be performed. <br />5.Schedule and method of payment, including down payment, subsequent payments, and final payment. <br />6.A provision stating the grounds for termination of the contract by either party. However, the homeowner must pay the contractor for work completed. If the contractor fails to commence <br />or complete the work within the contracted time period, the homeowner may cancel and may be entitled to a refund of any down payment or other payments made toward the work, upon <br />written demand by certified mail. <br />Homeowners should obtain a copy of the signed contract and keep it in a safe place for reference as needed.
