REGULAR MEETING <br />AUGUST 23. 1999 <br />There was no one present wishing to address the Council either in favor of or in opposition to this <br />Resolution. <br />Councilmembers Pfeifer, Kelly, Varner and Coleman along with City Clerk Loretta Duda thanked <br />Ms. Schwartz for her years of service to the community as well as her friendship. <br />Councilmember Kelly made a motion to adopt this Resolution by acclamation. Councilmember <br />Varner seconded the motion which carried by acclamation. <br />Ms. Schwartz addressed the Council and thanked them for the Resolution. She stated that it has been <br />a pleasure working with the Council as well as other organizations in the community and that they <br />will miss everyone. <br />RISE AND REPORT <br />Councilmember King made motion to rise and report to the full Council. Councilmember Sniadecki <br />seconded the motion which carried. <br />ATTEST: ATTEST: <br />orett d City Clerk Charlotte Pfeifer, Chairp so <br />Committee of the Whole <br />RESOLVE INTO THE COMMITTEE OF THE WHOLE <br />At 7:15 p.m. Councilmember King made a motion to resolve into the Committee of the Whole. <br />Councilmember Sniadecki seconded the motion which carried by a voice vote of eight (8) ayes. <br />Chairman Pfeifer presiding. <br />BILL NO. 59 -99 A BILL TO VACATE THE FOLLOWING DESCRIBED <br />PROPERTY: THE FIRST NORTH/SOUTH ALLEY EAST <br />OF KEMBLE ST. FROM THE NORTH RIGHT -OF -WAY <br />OF CALVERT ST. TO THE SOUTH RIGHT -OF -WAY OF <br />BRUCE ST. FOR A DISTANCE OF APPROXIMATELY <br />204 FEET AND A WIDTH OF 14 FEET. PART LOCATED <br />IN KEMBLE'S ADDITION, CITY OF SOUTH BEND, ST. <br />JOSEPH COUNTY, INDIANA <br />Councilmember Varner reported that the Public Works and Property Vacation Committee met on <br />this bill and sends it to the Council with a favorable recommendation subject to Easements granted <br />by both parties. <br />At this time Council Attorney Kathleen Cekanski- Farrand read a proposed amendment to Section <br />V. of the bill as follows: <br />Section V. This ordinance shall be in full force and effect from and after the <br />recording of an ingress /egress easement for the property located at <br />919 West Calvert and an ingress /egress easement for trash removal <br />services provided by the City of South Bend, and passage by the <br />Common Council and approval by the Mayor. <br />Council President Coleman made a motion to accept this amendment. Councilmember Aranowski <br />seconded the motion which carried by a voice vote of eight (8) ayes. <br />Mr. Patrick Nowak, representing Zahoran Funeral Home, 1826 South Kemble Street, South Bend, <br />Indiana, Petitioner, made the presentation for this ordinance. <br />----- - - - - -- <br />
