REGULAR MEETING <br />area have been met; and <br />JUNE 14. 1999 <br />WHEREAS, the Council issued a Confirmatory Resolution confirming the adoption of the <br />Declaratory Resolution as Resolution No. 2466 -97 on June 9, 1997; and <br />WHEREAS, the Petitioner has requested an additional period of time to complete <br />construction of the planned project. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South <br />Bend, Indiana, as follows: <br />SECTION I. The Common Council hereby reconfirms its Declaratory Resolution and its <br />Confirmatory Resolution designating the area described herein as an Economic Revitalization Area <br />for the purposes ofproperty tax abatement. Such designation is for Real property tax abatement only <br />and is limited to two years and nine months from the date of adoption of the Declaratory Resolution <br />by the Common Council. <br />SECTION II. The Common Council hereby determines that the property owner is qualified <br />for and is granted Real property tax deduction for a period of three (3) years, and further determines <br />that the petition complies with Chapter 2, Article 6, of the Municipal Code of the City of South Bend <br />and Indiana Code 6 -1.1 -12.1 et sea. <br />SECTION III. This Resolution shall be in full force and effect from and after its adoption <br />by the Common Council and approved by the Mayor. <br />s /Sean Coleman <br />Member of the Common Council <br />Councilmember Kelly made a motion that the Council consider the substitute version of this <br />Resolution. Councilmember Aranowski seconded the motion which carried. <br />Councilmember Kelly reported that the Community & Economic Development Committee met on <br />the substituted version of this bill and sends it to the Council with a favorable recommendation, as <br />amended. <br />Deputy City Attorney Jeff Jankowski advised that the second sentence of Section I of the Resolution <br />should be amended to read as follows: <br />"Such designation is for Real property tax abatement only and is limited to <br />two years and nine months from the date of adoption of the Declaratory <br />Resolution by the Common Council." <br />Councilmember Kelly made a motion to accept the amended version of this substitute bill. <br />Councilmember Sniadecki seconded the motion which carried. <br />Councilmember Hosinski informed the Council that he will recuse himself from voting on this <br />matter as his law firm represents one of the subcontractors on this project. <br />Mr. Daniel P. Thorsberg, 800 Port Street, Suite E, St. Joseph, Michigan, made the presentation for <br />this Resolution. Mr. Thorsberg indicated that this extension is requested so they can complete the <br />townhouse project which has been started. <br />A Public Hearing was held on the Resolution at this time. <br />There being no one present wishing to address the Council either in favor of or in opposition to this <br />Resolution, Councilmember Kelly made a motion to adopt this substituted Resolution as amended. <br />Councilmember King seconded the motion which carried and the Resolution was adopted by a roll <br />n <br />1 <br />1 <br />
