REGULAR MEETING <br />MAY 10, 1999 <br />BILL NO. 26-99 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, ANNEXING TO AND BRINGING WITHIN THE CITY <br />LIMITS OF SOUTH BEND, INDIANA AND AMENDING THE ZONING <br />ORDINANCE FOR CERTAIN LAND IN GERMAN TOWNSHIP <br />CONTIGUOUS THEREWITH; FISKARS PROPERTIES, INC. NO. 2, <br />23870 BRICK ROAD, SOUTH BEND, INDIANA <br />Councilmember Pfeifer reported that the Zoning & Annexation Committee met on this bill and sends <br />it to the Council with a favorable recommendation. <br />Mr. John Byorni, Assistant Director, Area Plan Commission, Room 1140 County -City Building, <br />South Bend, Indiana, presented the report from the Commission. Mr. Byorni advised that the <br />petitioners are requesting a zone change from "R" Residential to "D" Light Industrial to allow an <br />office building. The property is currently vacant and access to the property is from Brick Road. Mr. <br />Byorni further advised that the total site to be rezoned is 12,362 square feet with the building <br />occupying forty -nine per cent (49 %) of the site. The Area Plan Commission and staff sends this bill <br />to the Council with a favorable recommendation subject to a final site plan. <br />Mr Byorni noted that two (2) individuals attended the Area Plan Commission Public Hearing on this <br />bill and were in opposition to the rezoning. They were business owners concerned about commercial <br />use on Brick Road. Mr. Byorni also noted that there is companion rezoning in the County <br />concerning this project. <br />Mr. Robert Palmiter, Genesis Architects & Engineers, Inc., 300 North Michigan Street, South Bend, <br />Indiana, made the presentation for this bill on behalf of the Fiskers who are the owners of the <br />property. Mr. Palmiter advised that the additional piece of property will allow the developer to <br />expand the building by seventy -five per cent (75 %). He further noted that Genesis Architects & <br />Engineers, Inc. will be the primary tenant of the building. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br />There being no one present wishing to speak to the Council either in favor of or in opposition to this <br />bill, Councilmember Aranowski made a motion for favorable recommendation to the full Council <br />concerning this bill. Councilmember Sniadecki seconded the motion which carried. <br />BILL NO. 28 -99 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: <br />THE FIRST EAST /WEST ALLEY NORTH OF W. TASHER STREET <br />FROM THE EAST RIGHT -OF -WAY OF S. MAIN STREET TO THE <br />WEST RIGHT -OF WAY OF THE FIRST NORTH/SOUTH ALLEY EAST <br />OF S. MAIN STREET FOR A DISTANCE OF APPROXIMATELY 166 <br />FEET AND A WIDTH OF 14 FEET. PART LOCATED IN WHITCOMB <br />& KELLER'S BEVERLY HEIGHTS ADDITION, CITY OF SOUTH <br />BEND, ST. JOSEPH COUNTY, INDIANA <br />Councilmember Varner reported that the Public Works & Property Vacation Committee met on this <br />bill and sends it to the Council with a favorable recommendation. He also noted that the Board of <br />Public Works has submitted a favorable recommendation concerning this vacation. <br />Mr. Fred Voynovich, 3116 South Main Street, South Bend, Indiana, Petitioner, advised the Council <br />that the purpose of this vacation is to keep unwanted business traffic from the scrap yard from using <br />this alley. He noted that three (3) of his neighbors stated that they are in favor of the vacation. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br />
