ORDINANCE NO.0 a -g!3 <br />AN ORDINANCE AMENDING CHAPTER 17 OF THE <br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND, <br />INDIANA, BY THE AMENDING OF ARTICLE 7, <br />COMMONLY KNOWN AS SEWER SERVICE FUND AND <br />CHARGES. <br />STATEMENT OF PURPOSE AND INTENT <br />In 1980, the South Bend Common Council passed Ordinance <br />No. 6830 -80 which established a sewer service fund and related <br />charges which would be used for the repair of a sewer service consistent <br />with the ordinance. <br />Since the passage of this ordinance, it has been determined <br />that the deductible amount of $1,000.00 payable by the owner of the <br />private sewer is no longer necessary, and that said amount should be <br />reduced to $500.00. <br />The Common Council believes that the proposed amendment is <br />in the best interest of the City. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the <br />City of South Bend, Indiana, as follows: <br />SECTION I. Chapter 17, Article 7, of the Municipal Code of <br />the City of South Bend is hereby amended to read as follows: <br />Sec. 17 -58. Application of funds. <br />Funds collected under this article shall be used for <br />the payment of all costs in excess of- ewe- hesa�el- d��las- <br />f$47609 799} five hundred dollars ($500.00) which the City <br />declares to be directly attributable to the repair of a <br />private sewer service. Said costs shall not include any <br />charges associated with the removal or replacement of any <br />trees, shrubbery, plants, lawns, sprinkler systems, or other <br />landscaping features on public or private property; and <br />shall not be responsible for any expenses incurred in <br />tunneling under and /or replacing any hard surface ir,1.provements <br />such as bituminous, concrete, or brick driveways, patios, <br />sprinkler systems, gas grills, utility lines, foundations, <br />and any other surface or subsurface improvements found on <br />public or private property. Said costs shall include charges <br />associated with the removal and /or replacement of public <br />streets, curbs and walks. <br />Sec. 17-60. Charges to private sewer owner; payment. <br />(a) The owner of the private sewer shall be responsible to <br />pay to the City of South Bend the first- e��- ie�sae1- e1e��as- <br />i$ }7989799} -five hundred dollars ($500.00) of cost incurred <br />for all work as allowed under section 17 -58, "Application of <br />funds." <br />(b) Payment shall be due the City of South Bend within three <br />hundred sixty -five (365) days of date of invoice by the <br />Controller of the City of South Bend. Failure to pay as required <br />herein shall constitute a lien upon the property in favor of <br />the City of South Bend. <br />SECTION II.
