POST-ACCIDENT/INJURY INSTRUCTIONS <br />Visu-Sewer's Controlled Substances/Alcohol Policy requires each employee directly involved or whose performance <br />contributes to an accident must submit to a drug and/or alcohol test as soon as practicable after an accident. An accident is <br />defined as: an OSHA recordable incident, acts or omissions resulting in near misses, and accidents involving a personal <br />injury that requires treatment at a medical care facility; incident causing personal injury to another person who requires <br />medical treatment at a medical care facility; and/or property or vehicle damage of $1 ,000.00 or more. The Department of <br />Labor Occupational Safety and Health Administration (OSHA) defines a recordable incident as a work-related injury or illness <br />that results in death, loss of consciousness, days away from work, restricted work activity or job transfer, or medical treatment <br />beyond first aid. <br />The Federal Motor Carrier Safety Regulations require drivers of commercial motor vehicles to submit to drug and alcohol <br />testing as soon as practicable following any accident in which a driver: <br />1. Was performing safety-sensitive functions with respect to the vehicle and the accident involved the loss of human life; or2. Received a citation under State or local law for a moving traffic violation arising from the accident. <br />An "accident" is defined as an occurrence involving a commercial motor vehicle operating on a public road which results in: <br />1. A fatality;2. Bodily injury to a person who, as a result of the injury, immediately receives medical treatment away from the scene of <br />the accident or3. One or more motor vehicles incurring disabling damage as a result of the accident, requiring the vehicle to be <br />transported away from the scene by a tow truck or other vehicle. <br />Testing will be required in the above circumstances even if the driver involved is not at fault or if the driver's possible <br />contribution to the accident cannot be ruled out. <br />DRIVERS ARE STRICTLY PROHIBITED FROM USING ALCOHOL FOR EIGHT HOURS FOLLOWING AN ACCIDENT OR <br />UNTIL THE POST-ACCIDENT TESTING REQUIREMENTS ARE CARRIED OUT, WHICHEVER OCCURS FIRST. <br />ln order to ensure that the above requirements are met, in the event of g4y gig!g!, 4!_@gIg, are required to take the <br />following actions: <br />1. Stop immediately.2. Take all necessary precaution to prevent further accident at the scene.3. Render all reasonable assistance to injured persons (movement of an injured person should not be undertaken <br />to prevent further injury).4. Call law enforcement agency to report the accident,5. Give to any person demanding the same, the driver's name and address of Visu-Sewer, the State tag registration <br />number of the vehicle involved, and if requested, exhibit operator's license.6. Report all details of the accident as soon as possible after its occurrence to Visu-Sewer.7. Report to nearest approved medical facility for alcohol and controlled substances testing as soon as practicable <br />following the accident (Preferably with 2 hours after the accident and not more than 8 hours after the accident <br />for alcohol testing and not more than 32 hours for drug testing.) <br />Please note that these procedures do not require a driver to delay any necessary medical attention for injured people <br />following an accident or to remain at the scene of an accident when his/her absence is necessary to obtain assistance in <br />responding to the accident or to obtain necessary emergency medical care. <br />FAILURE OR REFUSAL TO FOLLOW THESE INSTRUCTIONS, INCLUDING THE USE OF ALCOHOL PRIOR TO THE <br />REQUIRED POST-ACCIDENT ALCOHOL TEST, WILL BE CONSIDERED A REFUSAL TO SUBMIT TO A TEST AND <br />RESULT IN DISCIPLINARY ACTION. <br />APPENDIX H
