Visu-Sewer may direct the driver to undergo <br />return{o-duty and follow-up testing for both alcohol and controlled <br />substances, if the substance abuse professional determines that return-to- <br />duty and follow-up testing for both alcohol and controlled substances is <br />necessary for that particular driver. <br />Before returning to work, any driver identified by a substance abuse <br />professional as being in need of assistance in resolving problems associated <br />with alcohol misuse or controlled substances use must also: <br />Be evaluated by a substance abuse professional to determine whether <br />the driver has properly followed any prescribed rehabilitation program; <br />and <br />Be subject to unannounced follow-up alcohol and controlled <br />substances tests administered by Visu-Sewer following the driver's <br />return to duty. The number and frequency of which will be determined <br />by the SAP and consist of at least six tests in the first 12 months <br />following the driver's return to duty. Follow-up testing will not exceed <br />60 months from the date of the driver's return to duty and may be <br />terminated at any time after the first six tests have been administered, <br />if the SAP determines such testing is no longer necessary. A follow-up <br />test for alcohol will only be required when the driver is performing a <br />safety-sensitive function or just before or after the performance of any <br />such function. <br />Discipline <br />ln addition to the removal from safety-sensitive functions required by the <br />Federal Motor Carrier Safety Regulations, Visu-Sewer will take disciplinary <br />action as detailed in this Controlled Substances/Alcohol Policy. <br />Recordkeeping And Reporting <br />Visu-Sewer will maintain records relating to this Policy in a secure location <br />with controlled access. All records required by this Policy will be maintained <br />as required by 49 CFR '390.31 and made available for inspection at Visu- <br />Sewer within 2 business days after a request has been made by an <br />authorized representative of the Federal Highway Administration. <br />Reporting Requirements (Management lnformation System) <br />lf requested by the FHWA, Visu-Sewer will prepare and maintain an annual <br />calendar year summary of the results of all alcohol and controlled substances <br />testing performed under this Policy. This summary will contain all of the <br />information required by49 CFR '382. ffi@). However, if Visu-Sewer's <br />annual calendar year summary contains only negative controlled substance <br />test results, alcohol screening test results of less than 0.02, and no other <br />violations of this Policy, it will have the option of preparing an"EZ" annual <br />summary containing the information required in 49 CFR '382.403(d). <br />a <br />a <br />a <br />o <br />o <br />46
