a <br />a <br />Refusal To Test And Uncompleted Tests <br />ln the event an employee refuses to complete and sign the Breath <br />AlcoholTesting Form, refuses to provide a breath sample, or <br />otherwise fails to cooperate with the collection process in a way that <br />prevents the completion of the test, the BAT or STT will record such <br />conduct in the "Remarks" section of the Form, terminate the testing <br />process and promptly notify Visu-Sewer. Any such conduct will <br />constitute a refusal to test. All employees are expected to exercise <br />good faith and cooperate during the collection process. Failure to do <br />so will subject the employee to disciplinary action, up to and including <br />discharge, independent and regardless of the results of any <br />subsequent test. <br />lf an initial or confirmation test cannot be completed for reasons other <br />than a refusal by the employee, or if an event occurs that would <br />invalidate the test, the BAT or STT will, if practicable, begin a new <br />initial or confirmation test, as applicable, using a new Breath Alcohol <br />Testing Form with a new sequential test number. <br />Action On Positive Result <br />ln the event a confirmatory evidential breath test yields a result <br />indicating an alcohol concentration level of .02 or greater, the <br />individual tested will be immediately removed from the performance of <br />any safety-sensitive function and prohibited from operating a personal <br />or other motor vehicle. That individual will also be responsible for <br />arranging appropriate transportation home or back to the workplace (if <br />Visu-Sewer did not transport him to the testing site). lf the individual <br />refuses to comply and continues to attempt to operate a motor vehicle, <br />Visu-Sewer, collection personnel and/or BAT will take appropriate <br />measures to discourage the individual from doing so, including <br />contacting local law enforcement officials. Any individualwho fails to <br />cooperate with any of the above procedures will also be subject to <br />disciplinary action, up to and including discharge. <br />a Controlled Substance Testing.
