Alcohol <br />For purposes of this Policy, "alcohol" means the intoxicating agent in beverage <br />alcohol, ethyl alcohol, or other low molecular weight alcohols including methyl and <br />isopropyl alcohol. "Alcohol use" means the consumption of any beverage, mixture, <br />or preparation, including any medication, which contains alcohol. "Alcohol <br />concentration" (or content) means the alcohol in a volume of breath expressed in <br />terms of grams of alcohol per 210 liters of breath as indicated by an evidential <br />breath test. <br />A driver may not report for duty or remain on duty requiring performance of safety- <br />sensitive functions while having an alcohol level of 0.04 or greater. The driver may <br />not use alcohol while performing safety-sensitive functions or perform safety- <br />sensitive functions within 4 hours after using alcohol. lf a driver is required to take a <br />post-accident alcohol test, the driver may not use alcohol for 8 hours following the <br />accident, or until a post-accident alcohol test has been taken, whichever happens <br />first. <br />The results of a breath test for the use of alcohol, conducted by Federal, State or <br />local officials having independent authority for the test, shall be considered to meet <br />the requirements of this section, provided such tests conform to the applicable <br />Federal, State or local controlled substances testing requirements, and that the <br />results of the tests are obtained by the employer. <br />Controlled Substances <br />For purposes of this Policy, acontrolled substances A mean those substances <br />identified in '40.21 (a). Although this Policy prohibits the use of any controlled <br />substance not lawfully prescribed by a physician, any drug test required under this <br />Policy will analyze an individual's urine to test for the presence of the following <br />substances: <br />. Marijuana. Cocaine. Opiates. Amphetamineso Phencyclidine <br />The driver may not report for duty or remain on duty and perform safety-sensitive <br />functions if he/she has used drugs. Visu-Sewer may require the driver to inform <br />Visu-Sewer if drugs are being used to treat a medical condition. (Exception: lf the <br />driver is using a drug under the direction of a licensed medical practitioner, and <br />he/she has been advised by the medical practitioner that the drug will not affect <br />his/her ability to safely operate a commercial motor vehicle.) The driver may not <br />report for duty, remain on duty, or perform a safety-sensitive function if the driver <br />has tested positive for drugs. <br />The results of a urine test for the use of controlled substances, conducted by <br />Federal, State or local officials having independent authority for the test, shall be <br />considered to meet the requirements of this section, provided such tests conform to <br />the applicable Federal, State or local controlled substances testing requirements, <br />and that the results of the tests are obtained by the employer. <br />2o
