REGULAR MEETING JUNE 12, 2000 <br />There being no one present wishing to speak to the Council either in favor of or in opposition to this <br />bill, Councilmember Varner made a motion for favorable recommendation to full Council <br />concerning this bill as substituted. Councilmember King seconded the motion which carried by a <br />voice vote of seven (7) ayes. <br />BILL NO. 27-00 PUBLIC HEARING ON A BILL AMENDING THE ZONING <br />ORDINANCE, AND ESTABLISHING AN HISTORIC <br />LANDMARK FOR THE STRUCTURE LOCATED AT 501 WEST <br />COLFAX, COMMONLY KNOWN AS THE REMEDY BUILDING, <br />IN THE CITY OF SOUTH BEND, INDIANA <br />Councilmember Varner made a motion that this bill be continued until the June 26, 2000 meeting <br />of the Council. Councilmember Aranowski seconded the motion which carried by a voice vote of <br />seven (7) ayes. <br />BILL NO. 45-00 PUBLIC HEARING ON A BILL AMENDING THE ZONING <br />ORDINANCE, AND ESTABLISHING AN HISTORIC <br />LANDMARK FOR THE PROPERTY LOCATED AT 3020 <br />BUCKINGHAM, IN THE CITY OF SOUTH BEND, INDIANA <br />Councilmember Kelly made a motion that this bill be continued until the July 24, 2000 meeting of <br />the Council at the request of the petitioner. Councilmember Aranowski seconded the motion which <br />carried by a voice vote of seven (7) ayes. <br />BILL NO. 44-00 PUBLIC HEARING ON A BILL TO VACATE THE FOLLOWING <br />DESCRIBED PROPERTY: THE ALLEY TO BE VACATED IS <br />DESCRIBED AS THE FIRST NORTH/SOUTH ALLEY EAST OF <br />WARREN STREET FROM THE SOUTH RIGHT -OF -WAY OF <br />WESTERN AVENUE TO THE NORTH LINE OF THE FIRST <br />EAST/WEST ALLEY SOUTH OF WESTERN AVENUE FOR A <br />DISTANCE OF APPROXIMATELY 132 FEET AND A WIDTH OF <br />14 FEET. PART LOCATED IN SOUTH BEND INDUSTRIAL <br />PARK ADDITION, CITY OF SOUTH BEND, ST. JOSEPH <br />COUNTY, INDIANA <br />Councilmember Varner reported that the Public Works and Property Vacation Committee met on <br />this bill and sends it to the Council with a favorable recommendation subject to contingencies <br />regarding easement and access for waste trucks. <br />At this time Council Attorney Kathleen Cekanski- Farrand offered an amendment to the bill based <br />on the contingencies referred to by Councilmember Varner. The amendment offered is as follows: <br />Section V. shall read in its entirety as follows: <br />Section V. This ordinance shall be in full force and effect from and after its passage by the <br />Common Council, approval by the Mayor, and subject to the conditions set forth in the June <br />12, 2000 letter of the Board of Public Works which is on file in the office of the City Clerk. <br />Councilmember Aranowski made a motion to accept the amendment as offered. Councilmember <br />Varner seconded the motion which carried by a voice vote of seven (7) ayes. <br />Ms. Karen Paredes, 2012 West Western Avenue, South Bend, Indiana, made the presentation for this <br />petition. <br />Ms. Paredes informed the Council that she would like to vacate the alley to get the parking lot right <br />next to her building to be adjoining without the alley dividing it. <br />
