BILL NO. 32-24 <br />ORDINANCE NO. 11132-24 <br />AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: <br />THE FIRST NORTH -SOUTH ALLEY NORTH OF MARION STREET EAST OF LAFAYETTE <br />BOULEVARD AND WEST OF MAIN STREET; and THE PORTION OF MAIN STREET LOCATED <br />BETWEEN THE NORTH LINE OF THE FIRST EAST -WEST ALLEY NORTH OF MARION, EAST <br />OF MAIN AND THE VACATED NAVARRE STREET <br />STATEMENT OF PURPOSE AND INTENT <br />To proposed vacation would reduce traffic conflicts with the emergency vehicles enroute to the Emergency Room <br />on the remaining portion of Main Street, as well as prepare for future development of the site within the block <br />between Lafayette and Main currently owned by the hospital. <br />Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged <br />with the authority to hear all petitions to vacate public ways or public places within the <br />City. <br />The following Ordinance vacates the above described public property. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF <br />THE CITY OF SOUTH BEND, INDIANA, as follows: <br />SECTION I. The Common Council of the City of South Bend having held a <br />Public Hearing on the petition to vacate the following property: <br />THE FIRST NORTH -SOUTH ALLEY NORTH OF MARION STREET EAST <br />OF LAFAYETTE BOULEVARD AND WEST OF MAIN STREET; and THE <br />PORTION OF MAIN STREET LOCATED BETWEEN THE NORTH LINE OF <br />THE FIRST EAST -WEST ALLEY NORTH OF MARION, EAST OF MAIN AND <br />THE VACATED NAVARRE STREET <br />hereby determines that it is desirable to vacate said property. <br />SECTION II. The City of South Bend hereby reserves the rights and easements <br />of all utilities and the Municipal City of South Bend, Indiana, to construct and maintain <br />any facilities, including, but not limited to, the following: electric, telephone, gas, water, <br />sewer, surface water control structures and ditches, within the vacated right-of-way, <br />unless such rights are released by the individual utilities. <br />SECTION III. The following property may be injuriously or beneficially affected by <br />such vacating: <br />018-1014-0540 — 531 N. Main St <br />018-1014-0546 — 524 N. Lafayette Blvd <br />018-1014-0547 — 506 N. Lafayette Blvd <br />018-1014-0549 — 215 W. Marion St. <br />018-1009-0344 — 509 N. Main St. <br />018-1009-0345 — Vac Lot 191 Main <br />018-1009-0346 — 207 W. Marion St <br />018-1009-0347 — 211 W. Marion St. <br />018-1009-036401 —100 Navarre P1 <br />018-1011-0400 — 621 Memorial Dr. <br />SECTION IV. The purpose of the vacation of the real property is to reduce traffic conflicts <br />with the emergency vehicles enroute to the Emergency Room on the remaining portion of Main <br />Street, as well as prepare for future development of the site within the block between Lafayette <br />and Main currently owned by the hospital. <br />SECTION V. This ordinance shall be in full force and effect from and after its <br />Passage by the Common Council and approval by the Mayor. <br />
