BILL NO. 32-24 ORDINANCE NO. 11132-24 AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST NORTH -SOUTH ALLEY NORTH OF MARION STREET EAST OF LAFAYETTE BOULEVARD AND WEST OF MAIN STREET; and THE PORTION OF MAIN STREET LOCATED BETWEEN THE NORTH LINE OF THE FIRST EAST -WEST ALLEY NORTH OF MARION, EAST OF MAIN AND THE VACATED NAVARRE STREET STATEMENT OF PURPOSE AND INTENT To proposed vacation would reduce traffic conflicts with the emergency vehicles enroute to the Emergency Room on the remaining portion of Main Street, as well as prepare for future development of the site within the block between Lafayette and Main currently owned by the hospital. Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having held a Public Hearing on the petition to vacate the following property: THE FIRST NORTH -SOUTH ALLEY NORTH OF MARION STREET EAST OF LAFAYETTE BOULEVARD AND WEST OF MAIN STREET; and THE PORTION OF MAIN STREET LOCATED BETWEEN THE NORTH LINE OF THE FIRST EAST -WEST ALLEY NORTH OF MARION, EAST OF MAIN AND THE VACATED NAVARRE STREET hereby determines that it is desirable to vacate said property. SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual utilities. SECTION III. The following property may be injuriously or beneficially affected by such vacating: 018-1014-0540 — 531 N. Main St 018-1014-0546 — 524 N. Lafayette Blvd 018-1014-0547 — 506 N. Lafayette Blvd 018-1014-0549 — 215 W. Marion St. 018-1009-0344 — 509 N. Main St. 018-1009-0345 — Vac Lot 191 Main 018-1009-0346 — 207 W. Marion St 018-1009-0347 — 211 W. Marion St. 018-1009-036401 —100 Navarre P1 018-1011-0400 — 621 Memorial Dr. SECTION IV. The purpose of the vacation of the real property is to reduce traffic conflicts with the emergency vehicles enroute to the Emergency Room on the remaining portion of Main Street, as well as prepare for future development of the site within the block between Lafayette and Main currently owned by the hospital. SECTION V. This ordinance shall be in full force and effect from and after its Passage by the Common Council and approval by the Mayor.
