SUBSTANCE ABUSE POLICY <br />SELGE recognizes the employees off -the job as well as on -the job -involvement with illegal drugs <br />can have a negative impact on the workplace, fellow employees and customers. Employees are <br />expected to report for work with no illegal drugs in their bodies and free of all adverse effects of <br />alcohol misuse. SELGE encourages employees to seek professional assistance any time for <br />personal problems, including alcohol or drug dependency that adversely affects their ability to <br />perform their assigned duties. <br />The purpose of this policy is to comply with Department of Transportation Regulations ("DOT") <br />49 CFR Part 40, Procedures for Transportation Workplace Drug Testing Programs, 49 CFR Part <br />382, Controlled Substances and Alcohol use and Testing -Federal Motor Carrier Safety <br />Administration, and 49 CFR Part 29, Drug -Free Workplace Act of 1988, and requirements of <br />government contracts. This policy incorporates these regulations for safety sensitive employees <br />and establishes these requirements for drug and alcohol testing along with their specific cut-off <br />levels for all employees. SELGE has adopted this policy and compliance with this substance abuse <br />policy is a condition of employment with SELGE. <br />This policy applies to all employees that are required to have a Commercial Driver's License <br />("CDL"), or are considered by DOT to be in a safety -sensitive position, full or part-time, contract <br />employees and contractors when they are on SELGE property or when performing any safety - <br />sensitive functions for SELGE. <br />Performing a safety -sensitive function means all time from the time an employee is ready to work, <br />begins work, and until the employee is relieved from all responsibility for performing <br />work. Safety -sensitive function may include, however are not limited to the following items: <br />All time on SELGE property, or Customer's property or facility, or other property, <br />or on any public property, waiting to be dispatched, unless the driver has been relieved <br />from duty by SELGE. <br />• All time inspecting equipment as required by 49 CFR Part 392 (392.7 & 392.8) or <br />otherwise inspecting, servicing or conditioning any Commercial Motor Vehicle ("CMV") <br />at any time. <br />• All time spent at the driving controls of a CMV. <br />All time, other than driving time, in or upon any CMV. <br />All time loading or unloading, attending a CMV being loaded or unloaded, <br />remaining in readiness to operate the CMV or in giving or receiving receipts for shipments <br />loaded or unloaded. <br />• All time repairing, obtaining assistance or remaining in the attendance of a disabled <br />CMV. <br />Additionally, this policy applies to all employees of SELGE from the time an employee is ready <br />to work, begins work, and until the employee is relieved from all responsibility for performing <br />work. <br />Le ate. See "Use of Medication". <br />Prohibited Substances. Any substance or illegal drug identified in the Controlled Substance Act <br />(21 U.S.C. 812) is prohibited at all times. This includes, but not limited to marijuana, <br />amphetamines, opiates, phencyclidine (PCP), and cocaine, as well as any drug not approved for <br />medical use by the U.S. Drug Enforcement Administration or the U.S. Food and Drug <br />Administration. Illegal use includes, but not limited to, any illegal drug, misuse of legally <br />prescribed drugs, and the use of illegally obtained prescription drugs. <br />
