<br />Mr. Jeff Myers, Staff Planner, Area Plan Commission, Room 1140, County -City Building, South
<br />Bend, Indiana, presented the report from the Commission.
<br />Mr. Myers advised that this rezoning is Common Council initiated to rezone properties as follows:
<br />1. From "A" Residential, `B" Height and Area to "A -1" Residential, `B" Height and
<br />Area;
<br />2. From "A -1" Residential, `B" Height and Area to `B" Residential, `B" Height and
<br />Area;

<br />Area;
<br />4. From `B" Residential, "F" Height and Area to "A -3" Mixed Use Multifamily
<br />Residential and Commercial, "F" Height and Area;
<br />5. From `B" Residential, `B" Height and Area to "A" Residential, `B" Height and
<br />Area;
<br />6. From `B" Residential, `B" Height and Area to "A -3" Multifamily Residential and
<br />Commercial, `B" Height and Area;
<br />7. From `B" Residential, "A" Height and Area to "O" Office;
<br />8. From "C" Commercial, "D" Height and Area to `B" Residential, "D" Height and
<br />Area;
<br />9. From "C" Commercial, `B" Height and Area to "A" Residential, `B" Height and
<br />Area;

<br />Mr. Myers further advised that the purpose of this rezoning is to eliminate spot zoning, to create a
<br />more orderly residential and commercial development, and to allow for the properties to be
<br />compatible with the adjacent uses. A site plan is not required for rezonings initiated by the Common
<br />Council.
<br />The Area Plan Commission, at its Public Hearing held on October 15, 2002, sent this petition to the
<br />Council with a favorable recommendation. While the Commission recognizes that further work will
<br />need to be done along this corridor in order to achieve overall zoning appropriateness, this rezoning
<br />represents a positive first step in that direction. By bringing zoning districts into conformance with
<br />the dominant use of certain areas along the corridor, this rezoning should have a positive effect on
<br />the corridor and surrounding neighborhoods. At this time, Mr. Myers provided a visual overview
<br />of the areas to be rezoned.
<br />Mr. John Oxian, 742 Sancome Street, South Bend, Indiana, made the presentation for this bill.
<br />Mr. Oxian advised that he is the Chairman of the Landmarks Committee for the Lincolnway West
