ADDENDUM TO THE AGREEMENT TO EXTEND THE TERM OF THE LOCAL GOVERNMENT SERVICE EXCHANGE AGREEMENT BETWEEN THE CITY OF SOUTH BEND AND ST. JOSEPH COUNTY FOR OPERATION OF THE SPECIAL VICTIMS UNIT THIS ADDENDUM to the Agreement, effective July 25, 2023 by and between the City of South Bend, Indiana ("City") and St. Joseph County, Indiana ("County") is made as of December 7, 2023. The following Addendum is incorporated into and made a part of the Agreement. RECITALS WHEREAS, the Parties entered into the Agreement, attached h6reto as Exhibit A, on July 25, 2023; and WHEREAS, the Agreement provides for a amendments; and WHEREAS, the Parties desire to amend the Agreement. NOW THEREFORE, in consideration of the mutual covenants and promises contained herein, the City and County hereby agree as follows: 1. All terms and conditions contained within the Agreement; unless otherwise modified by this Addendum, shall continue to be in full force and effect. 2. The Agreement term is modified to one (1) year, thereby the Agreement will end December 31, 2023. 3. The County's responsibility to pay is amended to Ninety -Seven Thousand Seven Hundred and Fifty Dollars ($97,750.00) which shall consist of the - amount due from the County of $57,570.00 and the amount due from the City $40,000.00. 4. The Agreement, as amended by this Addendum, contains the entire agreement between the Parties relating to the subject matter hereof. Except as expressly set forth in this Addendum, the Agreement shall remain unmodified and in full force and effect. In the event of any conflict, ambiguity, or inconsistency between the terms and provisions of this Addendum and the terms and provisions of the Agreement, the terms and provisions of this Addendum shall govern and control. 5. This Addendum may be executed in counterparts, each of which is deemed an original, -but all of which constitutes one and the same agreement. Delivery of an executed counterpart of this Addendum electronically or by facsimile shall be effective as delivery of an original executed counterpart of this Amendment.
