remodeling cost and, if machinery and equipment (Leased <br />Equipment) is part of the Project, the cost of acquisi- <br />tion and installation thereof; and the construction, <br />acquisition and installation necessary to provide <br />utility services or other facilities, including trackage <br />to connect the Project with public transportation <br />facilities, if necessary, sewage and waste disposal <br />facilities; and all real or personal properties deemed <br />necessary in connection with the Project, or any one or <br />more of said expenditures (including architectural, <br />engineering and supervisory services with respect to <br />any of the foregoing); provided, however, that no <br />reimbursement shall be made to Lessee for actual acquisi- <br />tion or construction costs, if any, incurred by it <br />prior to the passage of the inducement resolution of <br />the City of South Bend Economic Development Commission <br />relating to the Project. <br />(c) Payment of the legal fees and expenses; <br />underwriters fees and expenses; mimeographing, printing <br />and engraving costs incurred in connection with the <br />authorization, sale and issuance of the Bonds, the <br />preparation of this Lease, the Indenture and all other <br />documents in connection with the acquisition of title <br />to the Project. <br />(d) Payment for labor, services, materials and <br />supplies used or furnished in site improvement, if any, <br />and in making improvements on the Building, if any, all <br />as provided in the plans and specifications therefor; <br />payment for the cost of the acquisition of any machinery <br />and equipment constituting a part of the Project (Leased <br />Equipment) and the installation thereof; payment for <br />the cost of the construction, acquisition and installa- <br />tion of utility services, sewage and waste disposal <br />facilities or other facilities including trackage to <br />connect the Project with public transportation facilities; <br />and all real and personal property deemed necessary in <br />connection with the Project; and payment for the miscel- <br />laneous expenses incidental to any thereof, including <br />the premium on any surety bond required to be deposited <br />with the Trustee under any of the provisions of the <br />Indenture. <br />(e) Payment of the fees, if any, for architec- <br />tural, engineering and supervisory services with respect <br />to the Project. <br />(f) Payment to the Trustee, as such payments <br />become due, of the fees and expenses of the Trustee and <br />of any paying agent properly incurred under the Inden- <br />ture that may become due during the Completion Period, <br />or reimbursement thereof if paid by the Lessee. <br />IV-4 <br />
