Variance <br />requests shall be made in writing and will require supporting documentation and/or justification as <br />requested by the City. <br />Submitted justifications shall include documentation specifying the criteria that will not be met, <br />existing roadway characteristic, alternatives considered, comparison of safety and/or operational <br />performance, other identified impacts, proposed mitigation measures, and compatibility with <br />adjacent conditions. <br />1-4 FINANCIAL GUARANTEES AND PERMITS <br />Parties performing work within the City Right-of-Way are required to provide permits and bonding per <br />Chapter 18, Article 7 of the South Bend Municipal Code. The requirements for obtaining the <br />appropriate and applicable permit(s) (i.e. right-of-way occupancy permit, excavation permit, etc.) are <br />located in the municipal code and discussed in the below sections. <br />A performance bond equal to 125% of the estimated construction cost, and a maintenance bond equal <br />to ten percent (10%) of the estimated construction cost is required for all city work. Subdivision <br />development and other work that will be later dedicated to the City shall require additional financial <br />guarantees or surety bonds to ensure completion. For these types of projects, it is recommended that <br />the developer meet with city staff for initiating, identifying, and establishing these financial guarantees. <br />All requirements as noted in these construction standards and specifications and Chapter 21, Article 14 <br />of the South Bend Municipal Code shall be followed by the developer. Below is a list of permits, with <br />hyperlinks to the permit applications, that could be needed for a potential project.
