REGULAR MEETING <br />MAY 12, 2003 <br />8. Finally, the Council portion of the hearing takes place in which members will discuss <br />the bill and vote on its disposition. <br />Councilmember King advised that Bill No. 31 -03 will not be heard this evening because the <br />Petitioner has requested that it be postponed until the May 27, 2003 meeting of the Council. <br />PUBLIC HEARINGS <br />BILL NO. 30 -03 PUBLIC HEARING ON A BILL TO VACATE THE <br />FOLLOWING DESCRIBED PROPERTY: THE ALLEY TO <br />BE VACATED IS THE FIRST NORTH/SOUTH ALLEY <br />EAST OF FELLOWS STREET FROM THE SOUTH R/W <br />LINE OF INDIANA AVENUE TO THE NORTH R/W LINE <br />OF AN EAST /WEST ALLEY FOR A DISTANCE OF 165 <br />FEET AND A WIDTH OF 14 FEET. PART OF <br />STUDEBAKER' S 1ST ADDITION TO THE CITY OF <br />SOUTH BEND, ST. JOSEPH COUNTY, INDIANA <br />Councilmember Varner, Chairperson, Public Works and Property Vacation Committee, reported <br />that this committee held a Public Hearing on this bill this afternoon and sends it to the Council with <br />a favorable recommendation. <br />Mr. Brian Zbrzezny, 514 East Indiana Avenue, South Bend, Indiana, made the presentation for this <br />bill. <br />Mr. Zbrzezny advised that he is requesting this vacation to improve the safety of the community. <br />He noted that over the past three (3) years that he has lived at this address there have been a high <br />number of vehicles traveling through the alley at unsafe speeds. These vehicles do not stop for alley <br />intersections or cross intersections. Additionally, there have been several police chases through the <br />alley both on foot and in vehicles. Mr. Zbrzezny indicated that the alley to be vacated is located <br />between the two (2) properties that he owns at 514 East Indiana Avenue and 518 East Indiana <br />Avenue and is not used for trash pick -up. He also indicated that vehicles using this alley have driven <br />through his backyard by cutting the corner by as much as five (5) to ten (10) yards. Mr. Zbrzezny <br />noted that there are no garages that would access this alley and he plans to fence this area in once <br />it is vacated. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br />There being no one present wishing to speak to the Council either in favor of or in opposition to this <br />bill, Councilmember Varner made a motion for favorable recommendation to full Council <br />concerning this bill. Councilmember Coleman seconded the motion which carried by a voice vote <br />of eight (8) ayes. <br />
