REGULAR MEETING JANUARY 13, 2003 <br />Councilmember Kirsits noted that there are state and federal laws that govern this type of situation. <br />In September of 2001, the City of Mishawaka adopted an ordinance concerning military leave policy <br />and it is time the City of South Bend step forward and clearly state its position. <br />Councilmember Kirsits noted that at the time this bill was being put together there were three (3) <br />employees called to active duty and that number has increased. He read a brief letter from an <br />anonymous City employee who indicated that he was embarrassed when he was called to active <br />duty. He felt that he may have been an inconvenience to some people by being deployed to serve <br />his country. He stated that he did not start this war and he did not think he would be where he was <br />which was a dangerous place with a lot going on. However, he as well as all other City employees <br />who still serve our country, appreciate the Council's efforts to help them. He noted that regardless <br />of the outcome of the ordinance, they will continue to defend freedom so all families can rest easy <br />every night. He thanked the Council for their support. <br />Councilmember Kirsits noted that this ordinance will go a long way in supporting City employees <br />that may be called to active duty in the future. <br />At this time Councilmember Kirsits offered the following amendment: <br />This ordinance will be retroactive to January 1, 2002. <br />Council Attorney Kathleen Cekanski-Farrand offered the following amendments: <br />Section 2-117, Paragraph (a), Subparagraph two (2), the last sentence <br />would read as follows: <br />Each covered employee shall continue in such inactive status until the <br />earlier of ninety (90) days after such time as he or she is released <br />from active duty in good standing or the date of receiving written <br />confirmation of said covered employee being deceased, and where <br />applicable, the date on which he or she resumes active employment <br />with the City of South Bend. <br />In subparagraph three (3) strike the words honorably discharged from <br />service and replace with released from active duty in good standing. <br />On Page three (3) of the bill Section III would read: This ordinance <br />shall be retroactive to January 1, 2002 and shall be in full force and <br />effect from and after its passage by the Council and approval by the <br />Mayor. <br />Councilmember Kirsits added that some employees are actually making more money working for <br />the military so this bill would not cost the City that much. In some cases, the City employee may <br />be taking a pay cut and that is where the City will pick up the slack. <br />Councilmember Coleman made a motion to accept the amendments as presented. Councilmember <br />Varner seconded the motion which carried by a voice vote of nine (9) ayes. <br />
