REGULAR MEETING <br />JANUARY 13, 2003 <br />Lots Numbered One (1), Two (2), Three (3) and Four (4) in block <br />numbered Three (3) as shown on the Recorded Plat of William S. Vail's <br />Addition to the town, now city, of South Bend. <br />WHEREAS, the Real Property is desired for the purpose of conveyance to a not -for -profit <br />social service agency which is qualified under Section 501(C) of the Internal Revenue Code; and <br />WHEREAS, the State of Indiana is interested in selling said Real Property; and <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South <br />Bend, Indiana, as follows: <br />Section I. The Board of Public Works is authorized and directed to appoint two (2) <br />appraisers to appraise the fair market value of the Real Property. <br />Section II. The Board of Public Works shall give a copy of both appraisals to the Common <br />Council. <br />Section III. The Board of Public Works may not purchase the Real Property for a price <br />greater than the average of the two appraisals. <br />Section IV. The Board of Public Works may not dispose of the Real Property for less than <br />the purchase price. <br />s/Karen L. White <br />Member, South Bend Common Council <br />Councilmember Varner reported that the Public Works and Property Vacation Committee met on <br />this bill and sends it to the Council with a favorable recommendation. <br />Mr. Bob Case, Community and Economic Development, 12th Floor, County -City Building, South <br />Bend, Indiana, made the presentation for this Resolution. <br />Mr. Case advised that occasionally the City has the opportunity to work with the State on their <br />surplus property and what makes this situation unique is that the City also has the opportunity to <br />work for a local not -for -profit social service agency. He asked that the Council approve this <br />Resolution which will allow the City the opportunity to acquire this property and eventually <br />transfer it over to the not -for- profit agency. <br />A Public Hearing was held on the Resolution at this time. <br />There being no one present wishing to speak to the Council either in favor of or in opposition to this <br />Resolution, Councilmember Coleman made a motion to adopt this Resolution. Councilmember <br />Pfeifer seconded the motion which carried and the Resolution was adopted by a roll call vote of nine <br />(9) ayes. <br />BILL NO. 03-01 A RESOLUTION CONFIRMING THE ADOPTION OF A 0 <br />
