REGULAR MEETING <br />JANUARY 13, 2003 <br />Councilmember Kelly reported that the Health and Public Safety Committee met on this bill and <br />sends it to the Council with a favorable recommendation. <br />Mr. Thomas Bodnar, City Attorney's Office, residing at 1618 East LaSalle Avenue, South Bend, <br />Indiana, made the presentation for this Resolution. <br />Mr. Bodnar advised that he is presenting this Resolution on behalf of the Fire Department. He noted <br />that the City entered into an interim Interlocal Agreement five and one-half (5 1/2) years ago with <br />the County and then a five (5) year agreement which is now expired. This is a new five (5) year <br />agreement. He noted that it has been a win -win situation on what is essentially a net -net agreement. <br />It will pass along all costs reasonably associated with it and it is a flexible agreement. After two (2) <br />years the City will revisit the Agreement and incorporate increased costs and labor costs. He noted <br />that while the City can project these costs for this year and next, that will be the end of the current <br />CBA with the Fire Department Union. They have built in this ability as well as the flexibility to deal <br />with the situation to move one (1) of the county ambulances currently housed at the City's fire <br />houses to some other location. On behalf of Chief Taylor and the Fire Department, Mr. Bodnar <br />asked for the Council's approval. <br />Councilmember Kirsits noted that Article 11 indicates that in addition to the monies mentioned in <br />Paragraph 6, St. Joseph County shall reimburse South Bend for all overtime costs incurred by South <br />Bend arising out of the pregnancy of any female firefighter regularly assigned to an ambulance <br />covered by this agreement. Councilmember Kirsits noted that sometimes those paramedics are <br />sometimes transferred from City ambulances to County ambulances and he asked what weight this <br />has. <br />Deputy City Attorney Bodnar replied that this particular paragraph was in the last agreement and has <br />never had to be invoked. He stated that he does not believe the City has any intent of invoking it at <br />any time now but he does understand that there is a pregnant firefighter but she is not assigned to <br />an ambulance. <br />A Public Hearing was held on the Resolution at this time. <br />There was no one present wishing to speak to the Council either in favor of or in opposition to this <br />Resolution. <br />Councilmember Kirsits advised that he is a member of the South Bend Fire Department but on the <br />advice of the Council Attorney, he will not be violating any state statute by voting on this bill. <br />Councilmember Kirsits made a motion to adopt this Resolution.
